This is not my coin or picture and I don`t have access to it.
The owner says the cross at the back of Liberty`s head is raised and not gouged and has wear comparible to the rest of the coin,
Is this a minting error ?

No this is post mint damage. It is raised but it is raised by making the cuts at an angle and raising up a bulge on one side of the cut. It is than pressed down at the edge to try and hide the cut. This isn't the best example because if you blow up the image you can clearly see the cuts used to make the cross. Some of them are done really well and it only shows where the two cuts cross each other.
