If it's a proof, the easiest way to tell is look at the edge. If it's 40% silver, the edge will have a solid silver color. If it's a cupro nickle clad you will see a "sandwich" with a distinct copper center. If it's not a proof, with an S mint mark, then it is definitely 40%.
