Should I take coin in for misrepresentation on ebay

    Hi,

    I recieved a coin that I paid over 400.00 for and the ebay seller used another ebayer's picture to represent the coin. He told me I should of asked before I bid if the picture of the coin represents the coin he sent me. I feel his misrepresented the coin and I don't feel I should have to ask. I asked him after I have recieved the coin because the coin looked different than the pic on his auction. In an email I sent him after the auction he stated the picture on the auction is the same as the coin he sent me. Paypal wants me to go and get a letterhead from a coin dealer to state the picture isn't the same as the coin he sent me.

    1) I feel like a fool to go to a coin dealer and ask them to do this.
    2) How much would it roughly cost for them to do this?
    3) Is it worth doing it?

    I could probably get about 250.00 to 300.00 for the coin?

    I really don't want to mention the ebayer who did this.

    Any info would be appreciated.

    The dealer is in the wrong....go and find a dealer that will help you....he might do it for free or he might change alittle.
    Make sure to report the seller to Ebay and if you can I would leave feedback for him stating that he doesn't use good photos.
    I think there is a rule on Ebay that says NO STOCK photos for coins.

    It will be in your best interest to find a reputable dealer and work with him/her to get the serious coins you are after. All it takes is one bad ebay experience to find that out. So in no other way to express it, If you do not like getting burned, then always be able to hold the coin of interest in your hands or buy it PCGS or NGC certified..thats it.. This has ben my method and I have had great succes with it. I personally stick with PCGS as my TPG company and all gold is MS69 with only 2 in MS68. I collect the AGE series in all denominations and have never had a problem...

    Why not? If you tell us who it was, it might prevent one of us from being ripped off.

    I think there is a rule on Ebay that says NO STOCK photos for coins.

    I hope not as I've used stock photos (I always mention it) and I know a lot of sellers of common stuff (PF/MS sets, modern commems, bullion, etc) use stock photos.

    To me this amount of money is really nothing, it is the lying that ****es me off.

    I think I may just keep it and send it to ANACS to see what it will grade at. I know it will be low but at least I can have it in a slab.

    Did you pay with a credit card through Paypal? If you did, you can call the credit card company and do a chargeback.

    You'll likely never get a refund directly from the guy. Go get the letter from the dealer. If you don't get a good response from PayPal after a few days, do a chargeback on the credit card.

    Make sure you NEG HIM! An all CAPS neg that states he is a scumbag who tricks and steals from buyers.

    Maybe not but I thought there was something....
    WOW...sometimes it would be nice to have that kind of money and no care about it......if that is nothing to you then I would suggest you go get the letter from the dealer...I don't see why you would really need it but since PayPal ask for it then do it....it isn't going to cost $400 IMHO so it shouldn't matter much....

    I don't know if you are collecting coins or investing in coins....but Ebay isn't always the best place to buy coins....oh it can be great....but sometimes if you are going to be paying a few hundred it is best to find a dealer you can trust and either go in person and see the coins or find an online dealer you can trust to bring good coins to people like you.

    Ok, clearly the seller is at fault here. By using stock photos, or actually from other people's photos, this means that it is not clearly depicting what he is trying to sell to you. This indeed is a grave mistake as obviously you bid accordingly to what he is selling to you by the description and photos. But as for such, by using other's photo, he has to give something that is "SIMILAR" to it.

    As for such, he must be reported at all costs to tell him that using stock photo is NOT OK. By using such, he is deceiving people of what he is selling.

    In the middle of this link page you need to click on the "Show" link on the "Additional Information" bar.

    Note the THIRD requirement! It explicitly states "clear picture of the actual coin"

    Guidelines for coins and paper money sellers:

    * Read the Code of Conduct for Selling Coins & Paper Money on eBay.

    * Include all relevant information that is known about the coins or paper money; for example their origin, date of issue, and condition.

    * Include a clear picture of the actual coin or paper money item that is being offered for sale.

    * Include all information concerning any alterations that may have been made to the coins or paper money.

    * Specifically identify every individual coin or paper money item listed to avoid misunderstandings about the nature of the items.

    * If unsure of the origin or authenticity of the coins or paper money, please state this clearly in the listing.

    * If members would like advice or information from other coins or paper money enthusiasts, visit eBay's Coins & Paper Money Chat Board.

    Scotty Speedy is right about the stock photos, please follow the Paypal instructions and get the dealer letter. Most would be willing to help you. Actually, you might want to contact Susan at the Coalition of Internet Numismatists Against Fraud. She is a coin dealer who won't laugh at you for being defrauded and would either give you a letter or connect you with someone else who can give you the letter. Just click on the "Contact Us" button in the upper left of the page to send her an email.

    Hey file internet fraud charges! By pass ebay and paypal go directly to the goverment website and file!

    Hi,
    Report it to Ebay as a fraud. As shown by another post, Ebay does not allow the use of stock photos and you can use that as a basis to get your money back. Press the issue with Ebay.

    Make sure that you press the issue with Paypal first! If you open an ebay dispute first Paypal will not allow you to open a dispute with them until the eBay dispute is closed, which can be problematic.

    I hate stuff like that on ebay. Paypal is HORRIBLE though. I mean they do make it pretty seamless, but when you have a problem, good luck. I think that by-passing paypal would be a good thing to try, or at least send the guy that sold you the coin an email telling him you are going to file a fraud claim with Coalition or....., if that doesn't get his attention, I don't know what will
