Strange ebay transaction - what's your opinion?

Ok, so I won an auction (over melt value) for a complete set of Roosevelt silver dimes, most of them toned nicely. That all looks great.
Then I notice the seller has the EXACT same images and description in another listing.
So I ask them if I will be recieving the item in the pictures and notify them that they have the duplicate listing. They say yes, I will get the item in the picture.

Before I pay, I check to see if the duplicate auction is still up. Well, it is and it now has bidders. So I message them again asking if they could explain to me how this is possible, and why the listing hasn't been removed yet.

    This was their response:
"We have two of the exact same coins, the pictures were taken of the first one, the one you purchased, and that is the one you will get, we actually wanted to put as quantity available 2 but forgot to so we just re-listed it. Thanks"

Am I crazy by thinking this is weird? First of all, it's a whole set of coins, and they are described as toned. It's not like you can have an exact duplicate of a toned set of coins. So myself or the other winning bidder of the duplicate auction is not going to get what is pictured.

I am hesitant to pay for this item. Any thoughts? Should I just walk away from this?

Should I just go for it and see what happens? They do have a 3 day return policy and 100% feedback.

Yes, it is weird. However, you have no proof that anything is wrong - YET. Pay for them. If you receive something different, you can return them. If all fails with the seller, you still have the the eBay Buyer Protection to back everything up. i.e., if you don't pay, you will receive a demerit you can never get rid of but if you receive the wrong thin, the worst that can happen is that you have to spend some time trying to recover your money.

I agree with rlm, if they look different when you receive them return them and then file a case to get your shipping back

Thanks guys, that's what I will do. I was really trying to emphasis to the seller that the person who wins the duplicate auction will not be happy when they receive a set that wasn't pcitured. If it was for a set of BU dimes, that's one thing. But when us toned finatics don't receive the pictured item, we get upset. :)

Just received an update from the seller. They will be changing the images on the other auction to reflect the proper items. So, it all appears to be good. My next update will be posting the sweet toned beauties!

My advice: Continue with the transaction, but save the pics of the coins in case there is an issue and the listing pics go away.

Always purchase with a credit card as well. If you ever have to dispute the charges (which includes the shipping in the total), it's rather effortless with your credit card company as they'll back you up 100% most of the time, you can almost avoid Ebay's Protection mumbo jumbo as well.

It is my opinion that when dealing on Ebay, it is generally the buyer that holds all the cards. If you are wronged, you can easily get your money back.

It's the seller that is at risk.

Very good advice here guys. I agree ebay semms to favor the seller in most if not all cases. So I went ahead and paid, I am sure everything will be fine. I just didn't want the second winner to receive coins not pictured. My package is on it's way.

Yes, one should notice under each listing it says: "Seller assumes all responsibility for this listing."

Your credit card though will favor you though, 100% of the time. The buyer usually always wins any disputes. ;)
