    Hello all,

I am looking fo a little advice. I sold some bank rolled state quarters on e-bay a few weeks ago for a friend who has been in the coin collecting business for many years. He bought these back when each of the following states were made available and he put them away for safe keeping. The coins were advertised as 1 Lot Of Various State Quarters B.U. Bank Rolls. The lot included - 7 rolls of Delaware, 6 rolls of Kentucky, 4 rolls of South Carolina, 2 rolls of Tennessee, 2 rolls of New Hampshire, 1 roll of New York, and 1 roll of New Jersey. 11 were shrink wrapped and the other 12 were SF string paper wrapped. My friend also threw in an extra "surprise" roll. He wasn't sure what was in the middle because each end showed a different quarter. The asking price was $300.00. They sold relatively quick. When the woman received them she decided to open up the extra roll and found that it was a Delaware roll but it also had 2 Pennsylvania and 1 1997 quarter in it. So she decided to open up another Delaware at random and found some Pennsylvania and old quarters as well. She said upon further inspection of the other shrink wrapped rolls that some of them also looked like they had some old quarters due to smooth edges. So right now we are kind of in a ****ing contest with this woman as to what a bank roll is and what she received. I guess my question is what the definition of a bank roll is. My friend explained it to me as a roll that comes from the fed reserve via money shipping company i.e. Brinks, or some other. When you go and ask the teller for roll of Delaware she/he give you what she/he has and you take the chance of what is in the middle of the roll. You are not guaranteed that just because it shows 2 BU coins on the end that is what's in the middle. Please tell me if this is correct. Also I am curious as to what the actual street value is of the coins she received. I know this is kind of a he said she said deal but I am trying to gather as many fact about these coins as I can.

Thank-you for any and all of you advise.

Hmm first of all, how can you be sure that she isn't just making it up that she found other quarters in there? Sigh, ebay can be a pain in the neck. I'm not sure what to tell you, except that I hope it works out.

Basically any roll of coins you get from a bank can be called a "bank roll." The term doesn't necessarily make any distinction between a roll wrapped directiyl from coins received from the Mint or a roll of coins a bank has received, counted, and had re-rolled. As for whether or not the buyer has a legitimate complaint, it would depend on how it was advertised. If it was claimed that the rolls were solid rolls of a certain state quarter and a certain condition, then yes, I see that she'd have a valid complaint that what she received wasn't as advertised, whether the seller knew the claim to be true or not. If it wasn't described that way, and it was made clear that what was in the middle of the rools was unkonwn, then I don't see how she has any legitimate cause for complaint. Personally if I was selling rolls I wouldn't advertise them to be solid rolls of anything unless I knew that to be a fact for precisely this reason. To protect yourself, make it clear what you know or don't know about what you're selling so nobody can complain what they received wasn't as described.

I agree with Troodon. If the ad gave the impression that these were full rolls of specific states then you should offer a refund. And from your post above(The coins were advertised as 1 Lot Of Various State Quarters B.U. Bank Rolls. The lot included - 7 rolls of Delaware, 6 rolls of Kentucky, 4 rolls of South Carolina, 2 rolls of Tennessee, 2 rolls of New Hampshire, 1 roll of New York, and 1 roll of New Jersey.) it sounds to me like it did.

In this case its her word against yours. I'd say no returns if they we're opened by her. I don't believe her. You should be able to see the shrink wrapped quarters very easily. Make her send you a photo of them.

If the rolls were opened then I wouldn't return them...it seems like if you by something and open it then that item is your's.....maybe I'm wrong on this so see what others have to say.

Nope, once they're opened, too bad. What was the return policy though (although I really don't believe that's relevant)?

I appreciate the feedback. All of the quarters were purchased the year, month, and week they were released. So Dock and Troodon, your saying even though the bank said these rolls were what they were suppose to be and the end coins showed what they were suppose to be, that doesn't necessarily mean that's what's in them? That just seems very deceiving. I'm not saying it isn't possible but when you request these quarters you expect to get what you request. The reason that these coins were advertised the way they were is because that's what they were suppose to be. B.U. because that's what each end coin was.

Hey, I appreciate all of the help.

I pretty much agree with the others - doesn't matter if she opened the rolls though. What matters is the definition of a bank wrapped roll. They can and often do contain coins of various dates. There is no guarantee that the coins in a bank wrapped roll will all be of the same date or the same mint mark. She obviously does not know this.

When buying rolls at the bank of State quarters I always check the edge of all of the coins....not only does it show if the coins are older some of the time but it will also show if there is a clip or a blank plachet in the roll.

I've never had a problem with getting old coins mixed in with the new ones.....the bank gets boxes of the new ones and will not take the coins if they are older....so far so good.

Yuck. I hate it when deals go bad. Sometimes it's my own fault for doing the wrong thing early on. A lot of complaints are stupid petty little things but if you react poorly then it can get out of hand.

Unfortunately she's right. If you say that it's a roll of something then she has a right to expect that even though there's no way to know when the rolls are acquired. Most of the rolls now are just filled from hoppers and they can be filled with almost anything. When the big jumbo bags from the mint are put into the hopper there will be a mixture filling the rolls for a while before it's all solid date new coin. You have to be careful that you avoid these or you may later find the only two new coins are the ones on the end.

I'd suggest you imply to her that you looked at these rolls before you sent them and saw nothing remiss. Ask her if she saved any unopened so you can see for yourself. This should help her see the problem from your perspective. With any luck it will also help her to compromise on some sort of solution.

There are a few rules you'll learn as you do more trading and one of the first is to be pretty sure of exactly what you're trading. If it's impossible then let the other party know. Really this shouldn't be extremely expensive for you since the coin premiums are not that high and since she opened them there is no reason you should have to make up any roll premium. A lot of times if you simply insist on undoing a deal the other party will suddenly discover they didn't do that bad after all and will drop it all together. This is usually a real ace in the hole but it's possible to get back something much different than you sent. I'll usually be sure to be able to recognize at least a few things so if they don't come back I'll know they're dishonest or incompetent and can proceed accordingly.

So a couple BU quarters could be on the ends of a roll of ChuckEcheese tokens and you don't have to refund if the buyer opens them?

Well, our first decision was to refund her and that is what we will more than likely do. I just wanted to get a different take on it. We were in no way trying to deceive anybody who bought these. It was our fault thinking that she should know what a "bank roll" was and maybe we could've been a bit more clear in the description.

Agan, thanks for the feedback .

A bank roll is simply a machine rolled roll of coins received from a bank. There is no way to guarantee what the roll contains. That is why I have advised for years against paying significant premiums for "bank wrappd rolls" The 'surprise' roll hat showed two different quarters should have reminded you of that.

    Yes that is correct.

Can they return them in the same condition they were in when they were recieved? You sold an unopened rolls, the roll is now materially different than what was sold. No refurn on an opened roll because there is no way to prove that they haven't switched the coins. This is the same reason why most dealers include the cavet on coins that they selll that they are not returnable if the have been removed from the holder.

I'm not sure what advice to give other than two points of view. I would have expected the bank rolls to be of the quarters mentioned in the auction. I would be dissappointed otherwise. Your interpretation of what a bank roll is and what other perceive can be different as it appears the case. Before you listen to other and automatically assume she lying and doesn't deserve a refund look at her feedback rating. Above all do what right for the both of you.

A bank roll of quarters promoted as a bank roll of Delaware quarters - it would be expected that all the quarters contained in that roll are Delaware.
