Very Upset With eBay Coin Roll Purchase

    I definitely disagree. The seller shipped it (unless proven otherwise) - he should not be responsible if it gets lost or the seller claims non-receipt. Especially if he offered insurance as an option to the buyer. Why would the seller let the buyer decide if the seller is the one on the hook?

    To do a charge back is abuse of the credit card, and I do not think they would ultimately uphold it. In this case, the seller can prove that he sent it. Also, the PO is supposed to reject or at least make a notation on an envelope or package that is damaged when first mailed.

    If you can show that the wrapping was not sufficient, that is another story. Ultimately about all you can do is whack him with negative feedback, but he will retaliate with the sam no doubt.

    I sell and buy on ebay. As a seller, I give the buyer the clear option of uninsured shippig at the buyers risk, or insured shipping for an additional cost. As a buyer I ask for the same privilege. In many cases I take the risk to save some money.

    I think my credit card company which is my bank might be able to recover my funds if I didn't revceive the items I paid for. I may give them a call or stop in tomorrow. I think VISA cards have some sort of protection.

    Maybe the seller did send the package. But that doesn't mean I got what I paid for. I paid $$$, seller got $$$, seller sent items, got an empty package and there for didn't get what I paid for.

    It will cover it. When you file your Paypal complaint one of the questions that will be asked is "Did you receive a package? (Even of the package was empty.)" Just answer that question honestly. Paypal tends to side with the buyer so you should get your money back eventually.


    Now about the advice you've received from some of the others here, I think you need to disregard some of it. You have heard from some people who think that just because a seller offers insurance that that fact absolves the seller of any responsibility for the safe arrival of the package if insurance isn't selected. It has been my experience that that isn't the whole truth. The seller of an item is responsible for the safe arrival of that item at the purchaser's address according to Paypal. If it doesn't arrive safely the sender is at fault, regardless of how well it was packed or whether insurance was purchased. I'm an eBay power-seller, I know this from experience. I offer insuance on all my auctions and when a buyer refuses it, I have to weigh the value of the package and my ability to replace or refund a package that the PO fails to safely deliver; sometimes I buy the insurance and sometimes I don't. I mailed roughly 10,000 packages in the last 18 months and two buyers claimed non-receipt. Neither had purchased insurance, but I was on the hook for replacement or refund according to Paypal.

    I still haven't heard from the seller. I sent the e-mail on April 29th. I'll wait a little while longer today and see if I get a response. Then I report to PayPal. I just checked that auction and he only has 14 rolls left.

    GOOD NEWS! Everything was worked out! The seller is going to send me 5 rolls at no charge.

    Bulk lots on ebay are risky, I have never found anything spectacular, just some coins to throw in a box to show my grandchildren someday.

    Glad to hear this worked out well. This would have been a good one to post to eBay's discussion forums.

    If you read the eBay user agreement, ownership of the item is not transferred until the buyer receives it. Thus, any seller who dismisses responsibility for delivery of the item when a buyer refuses insurance is dead wrong.

    Don't let anyone fool you, my friend.
    If you pay for something with your VISA, and then do not receive it, you can contest the charge, and you won't have to pay.

    BTW, I'm glad the seller decided to make things right.
    For what he's getting for rolls of wheat cents, he can afford to do it.

    Then I guess the solution is for sellers to require the purchase of insurance qnd therefore increase prices for everyone. I prefer to have the option of lower shipping costs.

    I still disagree with this line of reasoning. If the dealer says uninsured packages are sent a buyers risk and then offers insurance as an option and the buyer declines it, the buyer is talking the risk.

    Also, ebay offers just about zero assistance for bad trades - I have been there once or twice. Their solution was to provide an online chat thread where the seller and I could go back and forth, but no one from ebay ever weighed in on our comments. You can always give neg feedback, but then expect it back.

    Seems like you declined insurance and rolled the dice and lost - the seller showed he is a class act by offering a free replacement. He avoided a bad situation for the both of you - you owe him the best feedback you've ever given anyone.

    Actually, this is the policy:

    "Unless the buyer and the seller agree otherwise, the buyer will become the item's lawful owner upon physical receipt of the item from the seller, in accordance with California Commercial Code § 2401"

    If the seller makes the stipulation that buyer is at risk without talking optional insurance, and the bidder still bids, I think that constitutes agreement.

    I agree, this seems to me to be the only solution to the problem, unfortunately.

    While I agree with your sentiment as an eBay seller, unfortunately Paypal disagrees, in my experience.
