Here's a coin that drove me nuts trying to get into the correct slab. There are plenty of fugly toned '49-D's out there, but for those of you that don't know about toner Franklins, finding a nicely toned 1949-D is amongst the hardest of all the coins in the series to find attractively toned, particularly with FBL. I originally bought this coin (about 20 years ago) as an NGC MS65, before either NGC or PCGS were giving Franklins the FBL designation. About 5 years ago I sent it back to NGC for designation review. Why it didn't FBL at NGC at that point in time was beyond me. I eventually sent it to PCGS. PCGS tends to be tougher on dark toned Franklins for whatever reasons, so in the first go around it probably got a 64fbl, but as I kept it in the slab they DNC'ed it the first time. Anyhow, after about a year I sent it back again and they MS65FBL'ed it. WAHOOO!!! IMO this coin is FULLY deserving of the MS65FBL grade.
forget the color, that is a fabulous strike for a 49-D!!! The color is also awesome, but you don't see 49-Ds struck like that one every day!
The reason NGC didn't assign the FBL is because of the scratch through the upper bell ines. NGC requires both sets of lines be full and no breaks - the scratch is a break. PCGS only looks at the bottom set of lines. Regardless of that, I'm surprised that either company slabbed the coin at all with that scratch.
It's barely noticeable in hand. It's a prime example of how different images can emphasize or minimize different aspects of a coin.
But it was noticeable in your photos by myself and another member. And I agree with GDs opinion, I'm surprised it received an FBL with that scratch on it through the lines.

an opportunity to make money on the coin as well exists once you get that 65 FBL slab. Mecha makes a good point that the wise buy the coin not the slab, but there's no shortage of people that will buy THIS coin just because of it's slab. I'd sell it and go find another, but some like to actually keep their coins for a while...
Thank you to those of you who made nice comments about the coin! To the assorted guys downgrading this coin, I've been collecting Franklins for 20+ years, specializing in them over the last decade. I think I have a fairly reasonable knowledge about the series, and I've seen the coin in hand while you have not. Over the years (both before and after the upgrade) I have had multiple offers from people who specialize in Franklins to buy the coin, not because of the grade level (although there is that), but because of the combination of toning and strike for a 1949-D. Now the potential exists that you can judge a coin more accurately from an image than they and I can by holding it in hands... but I doubt it. Let's just say I'm comfortable with the coin.
looks nice to me, I see the scratch or whatever it is. I don't even like franklin halves, horrible idea to replace the WL halves with that design.
I just started getting back into coins and I can't bring myself to buy franklins ever since the Philly's started beating on my Mets...hehe So I know even less about them then most US coins
