Unfortunately, these items seem to slip between all the regulatory cracks... These listings seem to be properly presented as "replicas" and "plated"...it's the folks that later misrepresent these coins that are breaking the law. I'm not defending these listings...in fact, I just spend the last hour or so trying to find grounds on which to make a Federal Trade Commission (FTC) complaint against eBay for posting these auctions:hammer:...couldn't find any.
What crack are you referring to? eBay; Federal law; I see no crack there. They are replicas (lister's word). Therefore, they must be marked and they are not. Period.
Federal Law covers "Numismatic Items"... 1. Has a Chinese Panda been used in commerce? No. 2. Does a Chinese Panda commemorate a person or event? No. ...then it's not a "Numismatic Item". encil: Ergo, the aforementioned "crack".
UHM, eBay is not commerce? Don't tell them that. They certainly think they are commerce. BTW, it does not say "used in commerce". It says "for introduction into or distribution in commerce". i.e. sold.

I read that to mean "a circulating coin...used in the exchange of goods". Don't get me wrong...I absolutely think that fake bullion coins shouldn't knowingly be sold via eBay!!! I believe eBay is violating "Ethical" standards of conduct, but I can't find where they're violating "Legal" ones...I wish I could!

I will guarantee you that eBay considers bullion a "coin" that cannot be replicated without it being marked, although I have not convinced them that it has to be marked "COPY" (in lieu of "replica").
OK...works for me. I just wish I could find a regulation that states this in unabiguous terms. I'm sure there's one out there...I just haven't found it, yet.

You keep complaining about the fakes you are finding, yet you seem averse to reporting them. You are posting them here for help in fighting them, I presume. If not for us to report them, just what are you looking for? What, or what else, can we do to help? On a side note, you were going to meet with a secret service agent (i believe it was) some time ago to discuss this. Did anything come out of that meeting? I have chosen to fight on eBay. Maybe it is only a temporary relief, but it is doing something and I can see the results.
I'm not averse to reporting them I just don't feel that it is my responsibility to regulate someone elses website. If they wanted to put me on the payroll (yeah right) I'd be all over it... but until then (yeah right again) I'll be apathetic to reporting things. That being said I have reported items before and they have been pulled. I was referred to a secret service agent by a detective friend of mine. I have several calls into him but have yet to receive a return call. As soon as I can get in contact with him I'll let you guys know how it goes. RLM I think that what you do is a good thing. I'm sure you have saved more then one person from getting nailed by fake stuff. I apprecieate the work you do and I'm sure others do too. I see it like this. Doing something about counterfeit coins on EBay is like being a police officer fighting against drugs. You go after the people pushing the stuff on the street (EBay listings) but at some point someone is going to have to do something about the drug cartel that is allowing these drugs to be distributed by the pushers. It's not going to be easy, or fun... but it needs to be done. Maybe this is why drugs are such a big problem today. hahaha!
There is a big difference between eBay and the drug cartels. What the cartels is is 100% against the law. All you have to do is catch them and they are gone. In eBay's case, you are going to have to show me any law they are violating. I do not think there is one out there. That means you have to start by making a new law. Here, you have an advantage over me. Oklahoma has at least one representative who is a coin collector. (Frank Lucas) The problem is that every collecting legislation he proposes seems to get shot down. At least today, it does not help that he is a Republican. Try electing some others to help him!
