I never dipped my toes into these waters, though I'll admit that they interest me. Heritage is doing an auction tomorrow on California fractional gold so I wasted thirty minutes perusing the offerings. One thing that struck me was the myriad of different gold hues from one piece to the next. Now I know that all coins tone differently, but it just got me to wondering. Being these were private offerings, does anyone really know the purity of these pieces? And secondly I had always thought the Coinage Act of 1864 addressed privately struck coins. All I can find is that it addressed the motto and addition of the two cent coin. Didn't the 1864 Coinage Act address privately minted coins?

It is in the law that it is illegal to produce coins or tokens of less the $1 (US Code Chapter 17 sec 336) but I have not been able to find when the law was passed. It isn't in the coinage act of 1864, that only covers making private 1 and two cents coins/tokens illegal. I thought it may have been passed in 1863 when they ended civil war tokens but it isn't in the statutes passed from Jan 1863 to the end of March. I am unable to find the statutes passed by the 38th Congress from April 1863 to Jan 1864. nor have I found it in the second session that ended in 1865.
