Most definitely people are convicted on intent, which by its nature is subjective. In most criminal cases, proving intent is the key to a successful conviction.

I know that. That wasn't my point. I meant that we can't judge this guy's intent at the moment, as we only have our opinion on it. If I'm shown rock solid evidence that his intent is to defraud, then I will change my statement. But my point is it appears that his intent to defraud is entirely subjective at the moment, and that he can't be convicted because of.

I can understand your interpretation, based on one ad, but this guy has over 400 and others I've looked at are equally misleading. Based on the multiple ads and the way he "dances" around the truth, it would be tough for this guy to prove ignorance. I wish I had cases when I was working this much of a slamdunk.

I'm not doubting what you are saying, I'm just asking for the sake of learning and getting a better understanding of the situation. Could you provide some links to his other auctions you feel he is using the same pattern?

Here are a few that absolutely are misleading - intentionally so. http://desc.shop.ebay.com/numismati..._trksid=p3911.m270.l1313&_odkw=cpoy&_osacat=0 Yet eBay nor the police do not believe that they violate any rule or law. How do I know that? The have been on eBay >10 year and they have received >40,000 feedbacks just this year. Secondly, I have reported them and I guarantee you I have more pull with eBay than you.

Go to the link I provided, then view his other items or store. One that I remember was for an "Authentic" 1976 Bicentennial Quarter (looked like circulated copper nickel) for $30.

LOL, So, you're more in with eBay than I am? lol How do you know what the police think? Are you "in with them" too. The government (and eBay) move slowly, but they do move.

Again, what name are you selling under on eBay?

Walk into more shops, stop take the time to know some dealers

Walk into more shops, stop take the time to know some dealers, do some buisness with some, go to shows - do this for 15 or 20 years and you find some good people to trade with - it's worked this way for me and everybody else I know in the coin trade, several hundred at least.

It's not so much about defending an ebay scammer as it is about stopping the shark frenzy to smear smut on an unsuspecting seller. Smearing smut on someone isn't cool at all. What may appear misleading to you may perfectly be a totally legal posting.

You could admit that you made an error on your calling and let it go at that or you could argue with rim forever and keep looking bad. Your choice. :eek:hya:

If over pricing something were against the law, there would be no jewelry stores, no art, and no professional sports.

Another doubting Thomas. Thank God there are only 3 of you so far that can't see the error of this sellers ways.

Why don't you pole COINTALK memembers on this and accept the results
or at least be placated by them?

They work a lot faster than you think - if you actually care in stead of trying to harass someone you do not like.

You're wasting your time defending this guy. I'm going to spend the rest of the day with the family. There's really nothing more to say to those who can't see the problem with this seller, so let's just agree to disagree. And, based on your statements here, I'd really like to take a look at your ads on eBay, so please post your selling name.

You're allowed to (Free to) do your one Count

I know a lady that is still really ticked because her new car had fewer cup holders than the salesperson claimed.

So WHY did I catch the grief because she can't could count or didn't check it out?

(This is a relative question)~I got over it, she didn't.

Who is making the mistake here? :desk:

Yeah, I hear what you're saying, but it appears a dealer with a "brick & mortar" shop is a little too "motivated" to cover his/her high overhead and I don't like being the one to do it for him/her.

There's nothing wrong with defending what is right!! If the seller was doing anything wrong rim would have reported it. That's the bottom line. I hope you learned something. Good day!!

    Please post the relevant law.
