    Thanks for the clarification.

It seems as if this forum is populated by others that appear to be self-proclaimed Ebay cops who should direct their wrath to the seller. With 20-20 hindsight, the seller probably could have converted the auction to a Buy it Now to sell the coin to me. As far as I am concerned, that would be his business, not mine.

Like the Fugio Cent sez "Mind Your Business". Maybe the pious folks here should ask themselves if they would have been so concerned about the seller's (or buyer's, for that matter) possible infraction of Ebay rules if they were in my shoes and just wanted to buy the coin (which, BTW, is fantastic). I wonder if the pious Ebay Cop-types would have walked the deal if the seller insisted on a private sale? Do 'ya think they might have become sinners if presented that opportunity? Perish the thought.

The kind of situation you are describing, Major...is exactly why I stopped even looking at "open bidding" auctions...and just look at the "buy it now" stuff. You wait a week for something to end....just to have it end suddenly because the seller sold it privately, usually w/o giving eBay their due. People invest their time in the auctions....researching pieces that are offered. My time's too valuable to waste on a coin that may or may not be there at the scheduled end of the sale. It's bad for eBay's business...even if you think it's none of mine....even though when it's offered publicly, and I may be an interested party (I wasn't) then that makes it my business as much as it is yours.

Thanks Nightowl, I appreciate your views.

If you don't mind, let's "turn the table" and permit me to ask you a simple question. Let's say that you really wanted to buy a coin that was listed in an Ebay auction, contacted the seller and came to agreement on price. Would you walk the deal if the seller insisted on a private sale?

If the seller adds a buy it now price....I'm "in"....if they want to do it outside eBay...I'm "out". There's no protection for the buyer that way. When we start talking about the kind of money you dropped for that coin....I would definitely require the legal protection that the eBay contract affords.

    Here's a story for you....

I was cruising the bay looking at coins, and happened upon a real nice 1873-S half dime....I mean really nice. I went to the coinfacts site to compare the coin to what they had pictured....and low and behold, that's exactly where the seller lifted the picture from. When approached about whether or not she took the pictures....she swore up and down that she did. So....either she was lying, or coinfacts had stolen her picture....which seems a bit unlikely.

The trouble with doing a deal outside of the protection of eBay....is that you have no way of knowing who you're dealing with...and whether or not they even own the coin.

What is your answer if you set aside the payment risk/protection issue? Put another way, would you walk the deal on a much wanted coin available to you outside of Ebay at a great price due to concern that the seller (or you) might (say "would" if you prefer) be violating Ebay rules?

BTW, Ebay's "buyer protection"--it is full of conditions, "gotchas" and deadlines and is virtually non-existent if you don't use Paypal. Check it out @ http://pages.ebay.com/help/policies/buyer-protection.html

First of all....it's hard for me to "put that aside"....secondly...had I not seen the coin on eBay, the seller has every right to end his auction and sell to me locally. But as I understand it....he didn't end the auction and cancel active bids, and in that scenario, the "would be" buyer has every right to be angry and should have every right to leave negative feedback.

My personal rule that I use for my own selling on eBay....is that if there is so much as a single bid placed...I will not add a buy it now, nor alter the listing in any way...nor end it. If it ends up selling for the opening bid....what you lose on one coin, you may make up on another.

OK Nightowl, that makes sense. I nevertheless am compelled to ask "Where's Waldo" (the answer to a simple question)?

Keep digging mbt. Have you justified it yet? Some day maybe you will figure out that most people on this site are basically honest and do not have to justify their actions.

Say your piece--I'm a happy camper notwithstanding the "rim job"!

I enjoy a healthy debate, and I certainly don't have to justify my actions to you. Let's just agree to disagree, fair enough?

    Have a nice day! :smile

    Mucho wrongo!

You & Big need to re-read eBay listing and bidding requirements.

It is NOT OK to sell an item to another eBay member while an auction is ongoing.

Even to the current higgest bidder.

Even if the Seller then ends the auction.

What, you think eBay is in the business of giving Sellers free advertising?

They're cheated out of their final auction fees when people do that.

Furthermore it's a violation not only of contract law but also several laws governing auctions as commerce.

    ending eBay auctions early

Sure, I'll be glad to 'splain it to you, Big.

The Seller can only end an auction early if the item is no longer available due to conditions outside the auction process.

    Reason?

I'm not gonna impersonate Stutterin' John so you'll just need to consult my post that immediately preceeds this post.

When an eBay member contacts an eBay Seller and cuts a side deal for a pending auction item, he's violated numerous eBay requirements and a boat load of contract & commerce laws.

Something I myself wouldn't admit to in a public forum.

The Seller's in the same boat with the Buyer.

And that boat's more like the Leakin' Leana than a Bayliner.

No he can't - rules here on CT don't allow users to self-promote their ebay sales.

He cannot post it in this thread, but he absolutely can post it on CT. He just needs to post it in the "AUCTION LISTINGS" or "OPEN" sections appropriately.

If anyone cares to read this, I used to be a counselor for ppl with issues of all kinds and the OP appears to be enjoying this attention but I'm sure that's obvious. Seems to me that normal ppl only look for positive attention. Others who seek attention at any cost have serious mental problems or are just sleazy. If anyone knows what area the OP fits in maybe you care to write about it.

Does anyone know the OP on a personal level?. Expose this fraud to protect other buyers on ebay, that's part of what this forum is for!! Don't we as coin collectors look out for each other?. You do the math!! I for one, would be happy to expose the OP!! :eek:hya:
