counterfeit collection ?

    I will not have any counterfeit coins I will only have REPLICAS. The diferance between a replica and a counterfieit is having the intent to defraud. I dont want to defraud anyone so I have Replicas.

    I am mainly a cent collector and would be collecting Replicas of cent's see what US code 18 section 485 has to say about cents

    18 U.S.C. § 485 : US Code - Section 485: Coins or bars
    Whoever falsely makes, forges, or counterfeits any coin or bar in resemblance or similitude of any coin of a denomination higher than 5 cents or any gold or silver bar coined or stamped at any mint or assay office of the United States, or in resemblance or similitude of any foreign gold or silver coin current in the United States or in actual use and circulation as money within the United States; or Whoever passes, utters, publishes, sells, possesses, or brings into the United States any false, forged, or counterfeit coin or bar, knowing the same to be false, forged, or counterfeit, with intent to defraud any body politic or corporate, or any person, or attempts the commission of any offense described in this paragraph.

    Oh and I have no degrees but I did work in law enforcement :)

    Edit: I almost forgot why do I care what the Treasury Department thinks they have no jurisdiction counterfeits fall under the Secret Service.

    The Secret Service is part of the Treasury Department.

    And MorganMan, when you asked your question did you specifically ask if it was illegal to own a counterfeit Morgan dollar, or a Seated Liberty quarter ? Or did you just ask if it was legal to own a counterfeit ?

    I suspect you did the latter. And if you did, then of course they assumed that you were asking about coins and currency that is in circulation today. And of course they would tell you that it is illegal to own that.

    But if you specify that you want to know if it is illegal to own a counterfeit numismatic item - then I think you are going to get a very different answer. I would even say that you could ask if it would be illegal to sell a counterfeit numismatic item as long as you specified that it was a counterfeit - and you would be told no, it isn't illegal. Precisley because there is no intent to defraud.

    Of course you could also always menton to them the case law on the subject, some of which has been listed in previous posts, where it was found in court, not to be illegal to own counterfeits. About that time I think you're gonna hear a lot of stuttering.
