This sounds more like an opportunistic robbery, the thieves were just looking for something to steal.

We have had problems here with "magazine sales" people and I don't open the door for them.

    EXACTLY!

Listen, all you feel-good, I wouldn't hurt a flea people like stainless are just fine and dandy. Really, good for you. I sincerely hope you can float through life without some scumbag ever assulting you or your family. That's how life works most of the time. However, I have no faith in that ideal. I choose to own guns and have a concealed carry permit. I am ALWAYS carrying a gun, at home or away, I am ALWAYS packing.

I have no faith in the police to save me or my family in an emergency situation. You see, the police are 99% REACTIVE, they show up AFTER the problem is over the majority of the time. I choose to be 100% PROACTIVE, always ready should a situation arise. I would not hesitate to use deadly force if my life or a family members life is threatened. I am 100% within my legal right to defend if threatened. Please don't try to school me by saying "I will go to jail". I have extensive concealed carry training in this subject. What training do you have? I am more than willing to take my educated chances by shooting and killing a threat before I would allow that threat to cause injury.

I totally agree! This country needs more people like you. We also need stiffer punishments for violent crimes.
I live in Florida, and we have the right to use deadly force as well.
I own plenty of weapons, and I am prepared to defend my family. If my dog doesn't get them ,I will!

I hate to say it, but stainless is right. If, in this situation, you were to shoot and kill the intruders, you would be charged. Would I do the same? Yes. Do I agree with you? Yes. But that does not change the state of our legal system. (Which of course need not be discussed here)

Not necessarily, especially in my city/county. Precident has already been set many times. In fact, this surprizing case occured not long ago:

    http://www.thehighroad.org/archive/index.php/t-235634.html

In Ohio, you're allowed to use deadly force under certain conditions. If you've followed the guidelines and situation justifies the action, you will probably not be charged. Start reading at page 19 of Ohio law:

stainless - Sorry for sounding harsh before, this is just a sensitive issue for me.

I can't get the PDF file, my adobe flash doesn't work. As far as your first link though, that sounds like a self defense act to me. The car was the kids weapon.

You're being irrational. Ohio just became a concealed carry state in 2004. If that guy had chosen to, he was allowed the right to carry a handgun on him in public anywhere he went. If he would have been attacked by these two thugs in the city at 1:00 p.m. in the afternoon, he would have been allowed to shoot them in public. They didn't pass the law just so people could weigh themselves down a few more pounds!

In this situation, if he showed the gun, the aggression stopped and the attackers fled, no, he would not be allowed to shoot them in the back as they're running away. If they continued towards him in an aggressive manner, he's completely within the law to let them have it! There would be no charges.
You should get a copy of the American Rifleman and read all the instances that happen on a daily basis across this country where average Americans save lives and property by defending themselves. The stories are endless. Young and old alike. But you won't hear it in news articles like this or the mainstream media.
They would prefer that everyone stay terrified and that they hopefully will beg lawmakers to take away their freedoms and rights to protect them. Unknowingly making us more vulnerable. You have to read and dig a little if you want the whole truth.
It would appear that many people here are not in tune with what has happened in this country over the past 20 years. Anyone who would like to become better informed should click this link, scroll down and watch the page load up for 10 seconds. Every blue state is shall issue meaning there are average citizens carrying guns on the street in every one of them and you will never know it. As long as you leave them alone. This comes as a shock to many people. :

Irrational? Not by a longshot. Wrong? Possibly. But there's a big difference between the two. I have read Rifleman. And I see the some of the stuff that goes on in NJ. I can't get a concealed carry permit there unless I'm a cop or armored car operator. Maybe with that in mind, you could reread my post in a different light.

If you're referring to the state of N.J. legal system and many others, I'm sure I agree. It shows N.J. as being a May Issue state so there is probably some way to do it if you wanted to and depending on where you lived, despite the antis. I'm not saying it would be easy. Many states, it comes down to the county sherrif in charge on who gets what and what their 'opinion' is on the matter.

Notice that Alaska went from no issue, to shall issue to unrestricted. AK and VT are both unrestricted meaning you don't need a permit at all. Anyone can carry. That is U.S. soil that you share with these folks!

I understand the legal system is screwed up in a lot of places and sometimes it's the luck of the draw which county or judge would hear your case...... if it even came to that. 'IF' it did, that might be a little easier to go through than getting beaten to death, wouldn't you say???? Sometimes the choice is clear, right is right and you take your chances.

In self-defense, I think most people realize deadly force is a last resort. Some are completely against people having that ability but they can't come up with a reasonable alternative for you. You're just supposed to play the odds to fit their status quo. In their world, anyone faced with this situation should cower down and simply become another victim.

I see it as, the guy didn't deserve to be beaten to death. In this case the bad guys win. He lost. Society as a whole loses. Now we have to pay for room and board for worthless individuals the rest of their lives. We lost a contributing member of society and gained 3 burdens.

The anti-gunners will say "that was a terrible thing to happen", then press on with their agenda, with heads in the sand and no reasonable alternatives. I'm open and willing to listen to alternatives. In many cases, calling the cops is NOT an available alternative, when there is no time. If there is time, than absolutely. Call them. But then you still might not have time while you wait. A phone isn't going to save you in a gun fight. Despite what Dateline tells you. I hope most people realize this by now.

I'm sure this will ruffle some feathers but I view not being at least somewhat prepared for this situation as a lazy, irresponsible, nieve, way for a man to be. I know you can't win 'em all but the percentage should be greatly in your favor with any preparation whatsoever! Especially at home!

Too many people have been programed by the MSM to have a victim mindset. I don't know why that is.

Most people work hard their whole lives to have what they have and get where they're at. No worthless piece of human garbage should be allowed to so easily take it all away from them in a matter of seconds, no matter what happens as a result of the prevention.

Yet in 2009, you can always count on the intellectuals, the sympathizers, to pick a statement like that apart and debate it. lol

Edit: BTW, I'm not pointing a finger at anyone in this thread.

I recall something like this happening, or coming close to happening, down here in TN. Victim got pinged a couple of times and then made it to his gun, intruder tried to run and was cut in half (shot in back, still inside victims home).... there was a parade for the the victim the next weekend. No charges were filed. God I do love the south !

I did not know Lowther, but a fellow member of the Stow Coin Club told me that Lowther had been a member of our club (I joined only a few months ago). So sad and needless a thing to have happened.
