Oh man. When it rains, it pours. I just read the whole thread. Skimmed through this last page. Sorry to hear of this. FWIW, I know someone who's in college who accidentally wrote a bad check to a gas station. Supposedly they didn't realize it. Supposedly. I don't know how you couldn't know but..... the gas station tried contacting them multiple times and they never got in touch (or they were ignored). The gas station sued. And we're talking about a tank of gas for a small car. Probably less than your $40. This person got summoned to court and ended up paying $500 over the deal. I don't know what the gas station got out of it. If it makes you feel any better, several years ago, I tried buying a pair of Oakley sunglasses as a gift for my then girlfriend's birthday. They were $180.00. Some Chinese guy in CA. Well, he never sent them. I paid with my checking account through paypal so I was screwed. I never got refunded. Ebay said paypal was responsible. Paypal said ebay was responsible and nobody did anything. So, I got to buy another pair that I actually received. My wife still has those sunglasses today. But she chooses to wear some other cheap ones now because "they work better". Well, anyway, most sellers on ebay state that you must allow 10-14 days for a personal check to clear before they will send the item. I think more people have gotten burned than we realize. And I imagine it's getting worse nowadays. That would probably be your best course of action if you choose to keep accepting checks. In most cases, especially for smaller amounts, I feel the 3% paypal fee you incur is well worth the money. For a 1.20 you could have eliminated all this headache and had the money instantly or not at all. If you only accepted paypal of course. In this day and age, if you want to deal online, paypal is just about a given and I think most honest people will opt to go that route and get it over with. I hate having to send anything snail mail. It takes too much time. Most probably feel the same way. I would say the pool of people that remain who only want to pay by check is a pretty well tainted one these days. Not all of course but the scammers are condensed into a much smaller pool of people (who would want to spend the time to send a check) with most others choosing to use paypal. Just a thought. So if somebody wanted to go that route, I'd make 'em wait next time. That's just business in 2009.

OH I have many many friends in that baseball bat club, if I had chosen to go that route. Those days are well behind me, for sure. What goes around, my friend, comes around! maybe not today, or tomorrow, but it's like a hawk stalking prey.
It seems to me there are a lot of people out there who are not really trustworthy, sure they will say things that sound trustworthy, but that is just PR. OTOH, the other day I paid for a purchase in a store with a new 50 and two of them were stuck together, the clerk gave it back to me, so it seems that some peoples are straight. It is like the joke where the man asks the woman if she will sleep with him for a million dollars, she blushed and said she would, then he asked if she would sleep with him for 10 dollars, she became upset and said, what kind of girl do you think I am? He said, we already established that, we are just settling on the price now.

Hey coinman, sorry to hear that this has not been resolved yet....but this is one of the most read threads..so I thought this is where I would let everyone know that my husband, daughter and I are moving to the Gulf...yea..he is working there now, and that is where our daughter was born. So, I probably won't be on here for a week or so. I have been busy packing. to give you all, an update on this situation, No word at all from harkenkc, has not returned my item as well. Bad Check prosecution in progress with his local county DA office.
UPDATE: Still no contact with this "buyer". It seems the only amount I will be able to recover is a total of $95.00, and legal prosecution is still pending his local D.A. action.
August 1st, 2009 I was required by Kansas state law to send a certified Restricted letter to my debtor, and demand a response within 7 days, from that mailing. In addition, I must also send all documentation pertaining to this situation, also certified letter to The D.A. after the elapsed designated time with no resolve. These additional costs, to me are another $15.00. USPS states they attempted delivery, no signer present. They will hold the notification 15 days before returning it to me unsigned . Than the DA can begin to actively prosecute.
Well, it seems the USPS was able to deliver the certified letter on Aug 3, 2009. I still have not heard from him.
This is just weird. What could be going on that would prevent this fellow from just taking care of the situation in a responsible way. I just don't get it.
who signed for it??...him/his wife/kid etc? I know that sometimes I'll sign for my sister - granted, the postman does know who I am, but either way.. Speedy
Heh, I have friends like that on Long Island and I'm not jk. They don't need any baseball bats. Usually they couldn't be bothered to get involved in things that don't affect their profits. I've never asked them for any favors. They respect that.
If the item was sent restricted he should have got it. This is from the USPS site.
