I believe these rejected coins are waffled at the mint and sent back to the planchet supplier for remelt. I would think that there would be an agreement that the supplier would not sell them, but who knows. Also the security at the foundry is probable less strict than at the mint. Just my thoughts.
There are thousands encapsulated by TPG's if that was the case they wouldn't touch them. It's been a questionable item for many years!

I read once that the government doesn't oppose to the waffled coins sales because they are not legal tender.
I did have 20 each of nickels and quarters from an Ebayer. Picked them up for 50 cents each and then resold. Have not seen many since that happened about 2 years ago.
The second one states Mint error. They waffle errors. I have been trying to figure out which mint error it had for years! Interesting right?
Maybe they label it mint error because if there wasn't something wrong with the coin it would not have been waffled. So it is a mint error, but because it is waffled you can't figure out what the error was/is. I don't believe the waffling is the error as the mint did the waffling so it came out of the mint with a perfect waffle (no error on that end). I wonder if there is an error involving the waffling? Like half waffled and half "normal".
I'm not sure waffling in and of itself is an error. It's done with the intention of making the coin unusable. The real error is in the ones that are not totally defaced and are identifiable. JMHO.
