YOU LOOK AT THE PHOTOS AND DECIDE FOR YOURSELF. THE MINTMARK IS UP WHERE IT SHOULD BE AND TILTED AS IT SHOULD BE FOR A D MINTMARK. THIS COULD BE AN S BUT IT HAS THE RIGHT POSITION FOR A "D" THANKS" So, it, once again, is the buyer's stupidity that rules.
Actually, the proper question is: where are the other 100,000 members of ebay who are NOT bidding. can 100,000 people be wrong? Apparently so.
Budget cuts. They had to close the "home" so they gave them computers and put them on ebay. They are real happy but have no money to pay for what they bid on (I hope).
Here's my version of "Let's be fair" - it is obvious to those who know what a genuine 1916-D dime should look like that the coin in question is not one. The seller should not have listed it as a 1916-D and appears to be looking for suckers. He can use disclaimers all he wants, but he knows or should know better.

oh no! I need them. I know that they are real, the seller promised it. And he wouldn't lie, he was from China! But I do have a couple of extra 1964 D Peace dollars that I can spare. (I want to keep the 1933 Double eagles.)
Good job and thanks to everyone who helped get this fraudelent listing removed! Now does ebay send an email to all the bidders on this fake coin to let them know what's going on? Or will the seller be able to contact the high bidder and make up some untruthful story to try to get them to buy the coin at their last bid? hmmmm
mr merc: Sadly all that the bidders get is a notice that the item was removed. No explanation, no statement that the seller was -- well, to put it nicely, wrong. And nothing to stop him the next time.
Ebay typically sends a message to bidders, letting them know the listing has been cancelled and suggesting that they don't do anything outside of Ebay, etc.
Well that's to bad, I've just got a feeling this person may try to do something else dishonest. It's still a credit to all the honest people on this forum that helped stop the auction.
