Got a new large cent. I asked Tom for permission to use his picture - if he says no I may have to remove the image. Can't wait to get this puppy.

The guy who snapped the photograph owns the copyright in the photograph, that's what Mark was referring to. In fact, if you want to be painstakingly technical about, that still applies, as respects this particular photograph, even after mark paid for and accepted delivery of the coin, until and unless a written copyright assignment has been executed. Hey, don't look at me, I didn't make the Copyright Act.
