This not mine, and it's certainly not right! https://www.ebay.com/itm/332545010718?ul_noapp=true Trademark infringement in seller's title is not legal. Seller notified, but no response. eBay notified, and it's still up. I haven't been able to get eBay to come up with a way for me to put the registered trademark symbol onto listings . . . Alt 0174, the normal way on other sites crashes eBay every time. Any ideas? - Mike
Is your user name actually a registered Trademark ? If it isn't, it should be. Then you could stop it - legally. As long as it is not Trademarked - I don't know that you can stop it.
If your name is trademarked, you can try joining eBay Vero at https://pages.ebay.com/seller-center/listing-and-marketing/verified-rights-owner-program.html. Try copying and pasting this into your title/listing: ™ Could it be possible that the seller is just saying the coin is 'tough' and accidentally missed a space between tough and coins? Or maybe he bought it from you and just threw it in to see if it would sell quicker that way?
Wow. That is rather blatant. I don’t do much on EBay but I am a believer in strongly worded letters.... Or emails as the case may be. Make sure the offender is fully aware that he is crossing the line with a man that means business.
First Trademarked in 2006, and later Registered with the Federal Government in 2012 (Ser. No. 85581702).
It would have been an enormous coincidence for him to accidentally forget the space and capitalize the word coins and even put the S at the end...
We should all just report the item so that eBay is like "Holy cow this item isn't good if there are four reports on it..." Except I've never reported an item nor been reported so I don't quite know what to do to report it. I know that there is the button that says "Report Item" above the description, but I don't know what to do next and I don't want to get into legal business and such without knowing what to do...
Copyright and trademark > eBay item infringes your intellectual property rights > Contact the eBay Vero program. I just reported it.
I didn't previously know about it, and looked at it after reading your first post, thank you for that. I'll find out how to get my information onto the VERO pages. - Mike
I also just sent a mail thing by contacting him saying it was illegal and that he should take your trademark name off of the title. I also sent him the link to this very conversation so that he knows I wasn't sending some random mail to him. I hope it was an accident or just someone who is a starter on eBay who didn't know that it was illegal.
Imitation may be the sincerest form of flattery, but I hope you jump into this guy feet first. He knows exactly what he’s doing.
Trademark is only good for 10 years so I hope you've renewed it. If ya have, read here. https://www.foxbusiness.com/features/how-to-handle-a-trademark-violation-of-your-small-business
Due to renew this year, as a matter of fact . . . it's on my task list. As for vigorously defending it, I shut down one website in Ohio that launched with my name, and he was very responsive. This is only the second time I've seen such an obvious duplication of the trade name.
Ok the seller replied. He knows what he is doing and he is cocky. I really seriously hope this guy gets caught. This is a snapshot of his mail back:
Reported to eBay. @toned_morgan I'd forward that reply to eBay... That's just uncalled for. Not that it'll ever matter (I don't sell on eBay anymore), but I'll block him as well... if I can find it...
eBay doesn't do anything about messages. You can swear and cuss and say and do practically anything you want...but when you say that you want to buy something outside of eBay, they close your account. eBay won't do anything about it. You would have to call them and wait hours on the phone for someone even if you tried to do something about it. I have seen much worse.
