Take a look at this auction please.

Now tell me what you get out of the "fine print".

"Terms and conditions: Different grading companies grade coins differently. Please look at the pictures carefully and bid on the coin based on your opinion of its value. In the event of any casualty the buyer shall be entitled to a refund in the amount of the purchase price plus shipping only. Any and all disputes will be handled in the sellers venue, Allegeny County, PA. By bidding on this auction you agree to the terms and conditions set forth above."

I get nothing out of the fine print as I don't think "GEC" is a grading company. The coin looks AU to me and other coins I have seen listed on Ebay in those holders appeared to be badly over-graded as well.

I would never bid on a coin like that and the seller's excellent feedback is the result of unknowledgeable buyers mistakenly thinking they are getting good deals.

is posting not the number grade but posting unc or bu againsted ebay regulations with only ngc and pcgs?

This little scam is commonly done on 1884-S Morgans because of the large price spreads between AU and Unc. So many 84-S Morgans in AU have been dipped and cleaned to be passed off as Unc. One should be very careful when purchasing an 1884-S Morgan that they believe is uncirculated.

My understanding is that sellers of "certified" coins not on the approved list may post things like "unc.", just not numerical grades.

GEC is pond scum, I know that and it is probably a nice AU and cleaned coin.

My fine print question involves settling disputes in Allegeney County, PA.

Looks to me like if you buy this over graded piece of crap and find out just what it really is then too bad. That is unless you want to spend a ton of money and time to dispute it.

That's what I'm asking here. Is it just me or yet another clever ebay scam?

Not sure - but you can always stop payment on a credit card. I know my father has done this twice after using paypal - and once he provided shipping proof they refunded his money. I mean what is the seller going to do - hire a lawyer to go after paypal or the credit card company? I don't think so - of course by picking paypal as a payment method I believe you have access to their problem resolution. Of course I would not want to be the one to test this, mainly because of the poor grading.

The only place he cannot post a numerical grade is in the title. There is nothing wrong with this listing - i.e. against eBay rules anyway.

I think what clembo is trying to point out is
I the event of whose casualty? Is he threatening someone?

Grade Evaluation Company GEC is an Alaska based self slabber, Sullys Coin, just like Abon/SGS.

The disclaimer means nothing but blah blah, same as on the ticket to an amusement ride at a theme park.

I have a link somewhere to the mfg. co that makes those slabs, anybody can buy them and fill them.

We've gone through this GEC crap before.

The've ripped me off and they continue to ripoff everyone else they sell to.

Over a year ago, I bought a 2007 ASE MS70 . It came with a scratch across one of the rays of the sun. It is SOOOO obvious that I wonder how these people stay alive. They totally disgust me as they are still selling their misgraded coins (along with SGS) to unsuspecting buyers who know no better.

Pond scum is too complimentary for these thieves.

Bruce and everyone else that has responded. GEC is NOT the issue here although we all know they overgrade the living crap out of coins.

It's the FINE PRINT in the auction.

I get the impression that if you bid, you get screwed, discover same and want to do something about it then you have to take it up in Pennsylvania. Not real convenient for most us.

Yes, all of his auctions are GEC crap but it could just as easily be SGS crap or other crap. Wow! lots of crap there.

The FINE PRINT screams scam no matter what he's selling and it's in all of his auctions.

    Now,
That being said I hope the seller has a crappy New Year.

As for the rest of you. I WISH YOU ALL A GREAT NEW YEAR!

    (man I'm crapped out) ;)

The fine print has served it's purpose IF YOU BELIEVE it. It is designed to discourage legal action, as I said above. The ride ticket on a roller coaster says park not held liable if you fall off or get injured, ticket is a waiver, on and on... only meant to discourage and intimidate. That ticket, AND his disclaimer wont hold a drop of water anywhere except if you let it.

IF there was a fraud or legal issue, it is federal, done on internet and across state lines, and if he mailed it, USPS postal inspector general has jurisdiction.

This is the educated opinion of Mrs. Arizona Jack, JD, I ask her everything legal, lol

I think Az Jack has a good point.

This is done on E-Bay and they have a dispute resolution process (for what it's worth). Same story if one uses Pay Pal.

I've only had one problem on e-bay that couldn't be resolved directly with the seller. E-Bay + Pay Pal dispute resolution combined got me satisfaction.

So this seller has no grounds to force anyone into Allegeny County, PA.

That said, I wouldn't mess with any auction with terms like that no matter what the coin was.

    Thank You Jack!

Could you tell it was irritating me?

Now we both know there's no way in hell I'd be bidding on that auction. For cripes sakes I don't even collect Morgans!

The problem here now is that Mrs. Arizona Jack does not reside in every household. The person that wins an auction like this and realizes they got burned (having never read the fine print) may just likely take their lumps (and loss).

Yet another cleverly disguised ebay scam. 9 out of 10 times this guy would get away with it just by quoting his own policy if questioned.

    Sad but true I'm afraid.
