Ebay doesn't have a report a counterfeit option. It does have one for replica/reproduction coins and all are prohibited (even legal ones). EBay doesn't remove them when reported. The same is true for the Von Nothaus NORFED stuff for which there was actually an adjudication that the NORFED pieces were counterfeits within the meaning of the law.
Why would the pro Carr side (you, cascade, and a few others) be charged with a crime? It is legal to possess and purchase counterfeits as long as there is no intent to defraud (as opposed to production of the pieces which courts have noted requires no such intent).
Expert as to what? The facts are not in dispute (i.e. that he produced the pieces), only the conclusions of law.
Then why was Von Nothaus convicted of "counterfeiting" when he didn't actually make them ? They were manufactured by Sunshine Minting, and they were never charged of any crime, nor did they ever have anything of theirs confiscated. The reason is because Von Nothaus' activities amounted to "uttering".
There is an opinion from the court on Von Nothaus's motion to acquit that discusses all of the issues. The court found him guilty under both theories/avenues (falsely making, forging, counterfeiting, etc.) and selling/uttering. It found the works to violate both paragraphs of 18 U.S.C. 485.
