Look up the Clerk of Courts website in the county that the case is being heard. You can put in the case number in the records search page and you should be able to pull up the docket of the case. That information should be public records accessible by anyone. Depending on the specific County, you may even have access to all the pleadings so you can read everything for yourself.

I don't understand how someone can be so savvy financially as the OP apparently is -- sending Heritage some millions of dollars of coins -- yet he isn't savvy enough to make a coherent post on these boards to explain his situation.

Every time I try to read one of his Heritage bashing threads the message is lost before he even starts. It's a profound inability to explain anything clearly. I hope your lawyer is writing up your legal documents, and not you.

Although the original case is listed as closed, I suspect it's just a technicality pending the appellate court's decision on whether or not the case can go to arbitration.

Discussing it at all seriously endangers his case, and certainly contravenes any advice a competent lawyer would give. It mystifies me why/how he's managed to continue posting prejudicial statements and debatable conclusions.

 

None of the quoted documents above really give us any information. All we really know is that one person is suing Heritage. None of the documents so far gives any details. I would love to see actual information, not just 'legalease' which is incomprehensible except to a lawyer (hint, Sallent, can you explain?). Can this guy give us details on what actually happened or is he just venting on a public forum?

 

What I'm about to say should not be construed as legal advise as OP apparently has a Texas licensed attorney representing him, but theoretically speaking if I was his attorney I'd be threatening to resign right about now. What OP is doing can have potentially disastrous effects on his case. He should honestly shut up, delete everything he's posted, and not say another word.

Everything he's posted here can potentially be used to impeach his credibility. If he so much as says something here that contradicts his testimony at trial, if I was the Defense attorney I'd have a field day with it.

Technically his statements are hearsay and cannot be used in court, but there is a loophole in most states that allows hearsay to come into court when it is in the form of prior inconsistent statements to impeach the credibility of the witness's testimony. So yes, there is a real danger he could be causing great harm to his case.

I can't tell him to shut it because I'm not his lawyer, and I'm here in this forum as a private citizen and not as an officer of the court, but I hope the OP calls his lawyer fast and do some damage control before he says anything else which could really sink his case.

One more note, I have not read the pleadings in his case because frankly the last thing I want to do in my off time is more work. Even if I had, I wouldn't dare comment publicly on what I think about the merits of his case, as I really would want to avoid saying anything that could get me in trouble with the Florida Bar's ethic committee. Dont want to be accused of practicing law without a license, as I'm only licensed in Florida, not Texas, and I have no business messing with things involving Texas law. There are people here who know my real identity, and even if no one here knew who I was, I'd still want to be careful.

Unfortunately none of us really know what his case is. He has made a few claims, but really doesnt explain much in this post or the other one quoted. It does seem to appear from his remarks that English is not his native tongue, so that may explain some of this. But, I would love to know just what the complaint really is. Some may not think this thread is relevant, but I do think so, as many consign coins to auction houses and would like to hear the story.

 

I'll try to see if I can obtain a copy of the complaint. I'm not sure how it works in Texas, but here in Florida is a fairly easy thing to do. I'll try tomorrow, and if I can get a copy I'll send it to you.

I'm not a member of any state's bar, but I have tried about 20 cases pro se, and I've learned how to read legalese. As a legislative Research Analyst, I need to. My OPINION in this case is that Stiel feels, with some degree of justification IMO, that the way Heritage handled his material, which sounds to me to be common knowledge as SOP, was more designed to enrich them as opposed to him.

All three of the next statements could be true at the same time:
1) It just seems shady.
2) He may be right that they don't put the consignor's interests above their own.
3) It's right there in the contract and he signed it.

The auction house's business model is to make money for them. If you make money too, everyone smiles and goes home happy. "He's not the client, he's the product."

 

The mistake you've made here is assuming that the assemblage of Mr. Stiel's wealth had something to do with being "savvy" or knowledgable. Yes, that's often the case, but not always. There are tons of very wealthy morons out there. Stuff sometimes just happens. Dumb luck is a bigger factor than more of us would like to admit. Also, seething anger has a negative impact on communication skills. I see it a lot.

 

I'm not following. He hasn't said anything, so he's following the advice given by some in here. I haven't read any other post by him, so maybe I'm wrong. But in here, so far, has he said anything other than post a public record? (If it's public, I don't know much). No harm done it seems

 

Actually, in other threads (see link posted by Carthago earlier in this thread), he's said quite a bit and even posted potential evidence.

Hi everyone Ive been under the weather a little and just now getting back to see your questions. First let me thank those that have decided already that Im a nut case, illiterate and a morran , excuse spelling and/or punctuation.
Also to the fellow that said I may not be a 100 percent American, my family have been in the US since about the beginning. I am French with a Jewish Father.
Questions about education or reference to, I have one semester at USL in Lafayette, Louisiana and thats all I could take, deciding to work rather than be broke all the time. I don't think badly of anyone that decides to finish college. However the group Im in has been more successful in business over the past 100 years.
My French Grand Father was a sugar cane farmer and in fact we still own the farm.
The Jewish side large scale merchants at a nice time to be in business in New Orleans, Louisiana. Ive heard New Orleans was very busy back in the early 1800s. A rumor maybe.
Im going to go back and reread the questions and reply shortly. Once again thanks for the the confidence and it was nice to see that HA had fans here too. Quit a few to be exact. To the couple of gentlemen who were positive towards me, appreciate it. Oh lastly I see others hit the wrong key while typing too. If I knew you required perfect correspondence with out typos, I would stuck to posting picture and we could all understand.
