Thanks for posting those images here. That is a series I’m not extremely familiar with. The detail on the obverse does look pretty soft, but for such a small coin with some wear I think some softness might be normal? I know you know your stuff so I definitely trust your judgement! Just did some comparison on CoinFacts. All three examples shown for 1865 show six horizontal lines versus the four on the eBay example. Another glaring difference in comparison is the detail in the kernels(?) of the wheat on the reverse. Fake has a very “dotty” appearance while the genuine examples have an overall more natural look. I’m sure there are many more differences that can be pointed out but those are the few that stood out to me…I didn’t even compare the letters or numbers.

First glance, VF/XF with some circ cameo. It's likely a nice coin at $100 or $125. $400 is ambitious.
From pictures can’t tell much of nothing. What criteria makes you think it’s fake. What is your background, expertise in US Coin grading? What do you have beyond the shadow of doubt to back up your claim it’s fake?
Previously trying to sell two fakes and denying they're fake to multiple people raises suspicions. Crappy images don't help their case. Nobody is claiming the most recent one is fake, so far.
If there going to fakes the should at least make good ones...LOL as far as ebay taking anything down we all know the answer to that one..$$$$
