why is there a noticeable scratch on this coin right above the date but has never been out of proof case?
sorry was trying to capture the toning more than the scratch, I'll upload a new photo when I am home. would this be an error if it is indeed a scratch or add any value to this comment or set?
No, scratches are not errors and they reduce the value of the coin. I'm guessing a tiny piece of cardboard from the holder caused the spot.
Unfortunately, scratches, fingerprints and other damage to coins (after they are struck), even though they are coming directly from the mint and probably caused by mint employees or machines, does not classify it as a mint error. Although, these types of anomalies are very interesting inside "sealed" mint sets, proof sets and other mint products, they could bring a premium to the right buyer. I've seen bugs, hair, fingerprints and rocks inside sealed mint or proof sets.
