The only thing you can do is block the buyer, but by that time, they have your item, denying they have it the whole time, then they would move on to the next victim. As for eBay I doubt they would look at things like that since there are so many of these individuals out there.
No, the seller has only two choices: leave positive feedback for the buyer, or leave no feedback for the buyer. Again, I wish it were different.
They do keep an eye on buying records. If a buyer files too many BP claims, eBay can ban that user from Buyer Protection. If a new account starts filing lots of cases against sellers with otherwise good reputations, I suppose eBay can suspend the account completely. Of course, that's no help to the sellers who've already lost their items and/or money. This is on my mind right now, because I had a couple of BP claims in the last few months, and I've got one guy right now who sent me a clad State Quarter proof set when he advertised silver. I approached him in good faith about straightening it out, but he's being really hostile and refusing to refund any shipping (for SNAD, original shipping should be refunded, and uncooperative sellers get dinged for return shipping as well). I don't think filing a case would get me suspended, but if it did, that would be a pretty costly refund. Without BP as a backstop, much of my eBay buying just wouldn't be worth the risk.
To clear things up... I did not have insurance. I am "self insured". So even with a few of these per year, I still come out ahead of paying for the insurance. Yes, it could be a postal employee... but the fact that he has no communication with me, and hung up when I told him who I was on the phone tells me all I need to know. Also, even if I had insurance, it would be pointless, as he is unwilling to talk to me. I would need the package, etc to file the claim. I reported him to ebay, and paypal said they were appealing the decision. I doubt I see my money again though. And to the one talking about karma? Whatever man. I am trying to warn other sellers of a thief.
Also, I would love to leave a "positive" feedback in all caps to warn other sellers, like another seller did for him, but he has not left a feedback for me yet. It would be a guaranteed negative for me if I did that.
you are right , I am a mail carrier and ,when , we receive a package torn , opened , empty , etc. we stamp it " received damage or missing content , as when we deliver it , we scan it visible damage , to assist in claims , but honestly , I do it to protect myself .
Forget about the local Post Office, call the Postal Inspectors and politely fuss big-time. They are EXTREMELY sensitive to complaints they have not investigated or followed up properly. Plus, NOBODY messes with them. They won't tell you this, but as far as I know, they can require addressees to pick up their mail at the Post Office instead of delivery. That's a powerful incentive to cooperate.
I actually received a package the other day like this, so refused to accept it. I wanted to make sure that seller knew I had no involvement in it. I also made sure to contact them and tell them what I knew. My guess is my customer's package was not received like this, but I will never know since he will not talk to me.
From my personal experience - you need to call PayPal and talk to a supervisor, showing him your past good history/record, tell him about the bad buyer and point out what you have found. In my case, which was exactly the same, the PayPal supervisor refunded me the money they took away, as well as refund the buyer. They can and will do this when they feel that both sides have a good point. Don't give up, and if one supervisor does not do this, hand up, wait 8 hours, and call again to talk to another supervisor. Another thing - when I get a supervisor with a heavy Asian accent, I hand up and call again, until I get someone with an American accent. The Americans are less restricted in what they can do for you, and you can actually understand what they are saying... Good luck & keep us informed!!!
OK, so you're saying Ebay seller protection doesn't exist. Your package can show that it has been delivered and the buyer can lie and say it was ripped open and the content is missing and you will still lose. Obviously Ebay is allowing people to steal using their terms and buyer protection does not exist. I bought a lower grade draped bust large cent from Wensy and the seller said "I will not be responsible for coins lost in the mail". I can understand why now. They are suppose to investigate matters when people are abusing policy but doubt they will. Have you talked to these people? Some can barely understand you. I agree, go to Paypal if you fulfilled your end to qualify for buyer protection. I think you needed to have signature confirmation.
This is why he filed the claim through paypal, not eBay. eBay has no involvement in the claim. Plus, a seller can state they are not responsible for lost packages, but they will still lose any claim filed against them.
I would call Paypal. They usually open a claim through Ebay. If you used signature confirmation you should be covered through seller protection. They can't just let people continue to steal which is exactly what they are doing. I could never do that, claim I didn't get something when I did regardless how they shipped it. It is the same if they broke into your house and stole it but if they got caught doing that they would go to jail.
I have called both ebay and paypal. I honestly don't know if I will get my money back since it is my word vs his. I have proof of delivery... but he claims it was an empty package. Not sure how I can prove he is lying, other than his other feedback stating he has done it before.
Call the postal inspectors. If you show that he's done it before, they'll be all over him. They don't mess around.
Yes, it is mail fraud. Reminds me of "Orange is the New Black" where one woman was getting all these packages and saying she never received them and would get a refund. Since your package shows delivery, they are obviously getting create to steal your stuff. I don't know how Ebay continue having sellers when they allow this to happen. If they want to refund the buyer it is on them but you should not be responsible.
Well the package should have been weighed. If so I'm guessing somewhere along the way the weight got recorded and you should be able to prove the package wasn't empty. Better yet, call his towns PO and talk with the post master and ask him to speak to the route carrier that delivered that day. Might be a long shot but you never know.
