It is the variety they claim it to be--the die was dated with a broken 2 punch. I would grade it ~VF30. There may be a couple spots of corrosion on the reverse near the shield.
That's interesting--what year is it? The picture is a little grainy, so I can't tell for sure if this is only on the tops of UNITED (unlike Longacre outlines, which are all around the letters)
It takes some experience knowing past sales of particular varieties to establish a ballpark value. Snow gives this variety "3 stars" which he says "A highly sought after variety with a premium between 3X and 5X". The coin is normally ~$15 in this grade, so $40 is probably a good good deal--if those little spots aren't active corrosion. Good luck--you may get it for less!
