I think Ebay is the worst run company

I had to pay the return shipping. They never accepted the return on ebay. So I would just be mailing them the coins hoping they would refund me. I sell a lot on Ebay and have to shell out money to pay for return shipping for every trivial reason. Why cant I be afforded the same benefit as a buyer, especially when Item was clearly not as described.

Fair enough. For that reason I might have done the same.

No where in the posting does it say that the item pictured is the item you will receive. Also, they were selling 9 of these at the same time, so it should have been obvious that you were not going to likely receive the exact item pictured. I also don't see any specific mention in the description of the item that they would be 1948 dated coins -- sure that date is in the generic auto-filled information by eBay, but not by APMEX. This is not a "SNAD" case -- as the item is exactly as it was described (90% Silver Franklin Halves $10 20-Coin Roll BU (Bank Wrapped)), it just isn't as you interpreted it to be described.

    ==========================

Looks like their return policy is pretty clear (I added red for emphasis):

    Exchange and Return Policy
We want our customers to be satisfied with their purchases at APMEX. At your request, we may, but are not obligated to, provide you with an opportunity to exchange certain Products you purchased for an identical Product in the event of a material defect. If we agree to do so, such exchange must be made within three (3) Business Days from the date on which the customer receives his or her items and only to those customers who timely and properly notify our Customer Service Department via an eBay member to member message. If approved, the Customer Service Department will give you instructions on how to exchange your items. You have no right to cancel or return any eBay Order. Shipping and handling charges are non-refundable unless it is determined that the product arrived not as described as the condition in the listing. For approved exchanges, you must follow all instructions provided by Customer Service, including carefully packaging the Product. You are responsible for the cost of return shipping and the risk of loss during the return shipment as part of the exchange. APMEX reserves the right, at its sole discretion, to reject any exchange that does not comply with these requirements. If an exchange is requested, we reserve the right to accept or refuse the exchange request in our sole discretion, and to require you to pay for any Market Loss on approved exchanges. Any Market Gain on refunds shall vest in and remain the property of APMEX.

Cancellations of eBay Orders with APMEX
Once we have issued a confirmation (a) all prices are locked-in and (b) there is a binding contract between us for your transaction. You have no right to cancel your eBay Order. If you default in your performance of payment or any other act required by you to complete your transaction in the times required by these terms, we may cancel any such eBay Order. We reserve the right to cancel any eBay Order at any time and for any reason.

    eBay Order Changes
eBay Order changes are not permitted. We suggest you take the time up front to make sure what you want is exactly what you request from us as reflected in your eBay Order.

I expected a roll of franklins in a bank wrapped roll marked with the federal reserve bank of Minnesota. That is not what i received. So you can copy and paste all you want, but if one is going to sell on ebay, you better send what the picture shows or you run the risk of returns. In others words you are wrong.

It is not against eBay policy to use stock photos. If you are truly so versed in using eBay as a seller and buyer, then you should have known better. Find me a single place in the posting where it says anything more than the fact that they were bank wrapped -- NOTHING about Minnesota or specific type of bank wrapping.

Your wishful thinking and hoping doesn't change the fact that this was clearly a bulk list, since there were 9 for sale at the same time.

I never said it was against policy. Its not crazy to think there were 9 rolls stamped by minnesota fed.

Well, good luck with your return, but IMO the fault is yours not that of APMEX. I don't think I'd be nickel-and-diming them over return shipping cost if they are willing to take your return at all.

Here are additional details that Apmex provided in the listing:

Occasionally, we get large lots of Brilliant Uncirculated 90% Silver in original bank rolls, and we are passing the savings on to you! This is a great opportunity to buy rolls of BU 90% Silver in the original, unopened and unsearched bank wrappers from more than 50 years ago.

That is much more specific than simply "bank wrapped". If the rolls appeared modern as the OP stated he received, this is clearly false advertising. Even if the rolls were from another bank other than Minneapolis there could be room for argument if they looked reasonably original, but they shouldn't be something that got wrapped two weeks ago. That would be a deciding factor for me if I was buying them.

I would love to see a picture of what the OP actually received.

I absolutely detest the detailed item info boxes. You're absolutely right - a bot frequently fills in the wrong information, especially when using "sell a similar item." I have a feeling that this same code mess-up keeps changing my BIN prices after I adjust them and scrolling me back up to the top of the page. Not to mention all the sellers that show a PCGS MS67+ coin (from the PCGS item specifics that can be automatically uploaded) when they are clearly not selling such a high-quality piece.

It adds about ten extra clicks per listing, and I wish there was a way to COMPLETELY disable it.

I believe, if you really want to be unhappy/frustrated, start selling on eBid.

After reading the auction and the sellers terms, I feel the buyer should pay any shipping charges. Those were the terms. They kept their part of the deal.

No they didn't. They didn't send original rolls. This has nothing to do with info boxes that auto populate. The seller dug his own hole by describing in glowing terms how original the rolls were when they really weren't. When I buy something on Ebay I expect to receive exactly what was described, and shouldn't be left holding the bag if I don't.

I mean no hard feelings, I just think you're being a bit melodramatic in your interpretation of all of this. You received a reply from APMEX with instructions on how to return the coins, yet you skirt these instructions and open a case on eBay. It clearly states in their listing that to return an item you MUST follow the instructions received by their Customer Service.

I'm confused why all of this is such a big stink for you. Just send the coins back as instructed and be glad they let you send them back at all -- as the listing clearly states that returns are not accepted. Sure, there is always the "back door" of claiming a SNAD on eBay -- if you want to be one of those types of buyers. Being as how you are a seller/dealer yourself on eBay with more than 900 items currently listed an over 3700 feedback, I just can't quite figure out why you're being so stubborn on this.

this thread was started because of Ebay's response to my case. Telling me i need to send coins to a TPG to verify damage. It was never intended to start a debate on return policy or Original rolls, that just where the thread went. I just thought it was weird response, that makes no sense. I dont care if they honor the return or not, I dont sweat the small stuff.

I have a hard time believing any normal seller could get away with those terms.

I don't understand where you get your info.

Actually it is. It is against guidelines when coins are involved.

    http://pages.ebay.com/help/policies/currstamps.html

    • Include all relevant information that you know about the item, such as origin, date of issue, and condition.

    • Include a clear picture of the actual item being sold—don't use stock photos.

    • Include all information about any alterations that may have been made to the item.

    • Individually identify every item listed to avoid misunderstandings about what is for sale.

    • Don't list the item if you're unsure of its origin or authenticity.

I'm confused what listing you are reading. He bought a bank roll with original wrapping and he didn't get it. Thus the coins were viewed before thus it is a snad. Forget the 1948 issue. The true issue is this roll was searched.

As to your opinion, it would probably change radically when you get snaded. I can tell you how pissed I was when I was snaded. Personally I'm with the op on this one. And when snad you shouldn't have to pay to ship something when the wrong item is either intentionally or unintentially sent. How would you feel if you paid the extra dollar for Heinz ketchup and was given a white label brand?

I would (and have) snad them. They screwed up I don't like paying for others mistakes. I really think you should have.
