Ebay sellers, Help Please!

    File a case. Immediately if not sooner.

    If you do nothing for three days after receiving the item, you have implicitly agreed to the refund.

    Judging by her behavior, she is not brilliant. Refund her money, then sell her the Brooklyn bridge.....at a discount of course, since its covered in snow right now.
    Or offer her a bright, shiny new Lincoln cent in a straight up exchange, fresh from an "unsearched" bank roll! See if she takes the bait.
    When you are harmed by someone's stupidity, I see no reason not to leverage it back to your advantage.

    That's why I have a no return policy with eBay, let the buyer fight it out with eBay and always CYA by taking lots of pictures....if they alter the coin you have proof. Sorry for your loss.

    There is no such thing on ebay. My father just dealt with one who told him at least twice no refunds. He just filed a case with ebay, they said ship it back and they returned all money including return shipping. There are still bad sellers out there and he just found one.

    Thats not a very fun lesson for us though Vic, as it takes good sellers out of the arena, and thus good coins.

    Just give ebay a long explanation of what happened; she may have done a switch of the coins as I had someone in Texas do that to me once; ebay has experience with this stuff and will act accordingly....

    Possibly if you persist, ebay will still refund her monies, to them a certain amount is negligible compared to the cost of continuing to argue with a buyer. But they may also at the same time give you your money, since it was not your fault, which is a win-win for you and the buyer in that respect. Of course ebay loses, but they do have a certain amount (as do a number of other companies) in what they are willing to give up to avoid long contentious arguements or lose customers.

    And if they think she actually did switch the coin or damage it they may just suspend her and not tell you.

    So do file a report on her and persist (up to the point where ebay will penalize you or freeze your accounts..... this isn't worth that result, even if it hurts you on this coin).

    Sad, but, been through this...BUYERS win almost all the time..BLOCK the buyer..call ebay, and, at least try..it involves a LOT of time and energy..pics, documentation, tracking..emails...the thing that SUCKS with ebay, even if you list as NO RETURNS, the buyers can still open a case, say it "isn't as described", send it back, YOu don't give a refund, but EBAY DOES, then, BILLS YOU...if you don't pay, they suspend you, so, it's a JOKE..the buyers KNOW this...ever since ebay took the option for seller's to leave negative feedbacks, it's turned into a freakin zoo, with scammers galore, who KNOW how to win every time, no matter how nasty they are. I lost a long time account over a PRO scammer, and silver..he did the same thing to 7 other silver sellers, and won each case..always the same thing.."underweight", and, wanted a partial refund..it was pure and simple blackmail...I left "NEGATIVE" in the feedback box, and, ebay canned me..go figure...since you CANNOT view past feedback sales anymore, and find FEEDBACK REMOVED, which used to be an indicator of a bad deal, there's no way to see if your buyer is bad news or not anymore...in the old days, more than 2, 3, or more negs, and, you knew something was up

    BTW, if selling older Silver coins...get a DIGITAL SCALE..post pic showing weight on auction..and, ALWAYS take pics of coin(s) being mailed NEXT to printed shipping label, as the #1 scam is crying "nothing in packet", or, "coin #5 missing"...believe me, I learned the hard way to do this..NEVER list a slabbed coin as "Possibly Undergraded", as the scammers will buy it, see if it is, if not, just send it back...happens ALL the time....

    Won't work, even if refused it shows that it was delivered as far as ebay is concerned. Ebay will still refund and they will also have the coin back.

    I have a special way of dealing with this situation and win. For more valuable items, I weigh the item myself, take photos, and pay for the postage through eBay and drop it off in person at the PO. I then get a receipt for the weight that the PO has scanned in and verified. If the buyer claims the coin is missing, I asked if there were any tears or openings anywhere on the packaging (usually the response is no). You can ask them to take photos, even send the mailing package back, etc. The USPS may also stamp torn/open packages, so that will be an indicator of legitimate empty packages.

    You then know by mathematical logic that packaging materials weigh X amount, yet the PO verified weight of the package which is NOT disturbed in any way until the buyer received it, weighs a lot more. You have the buyer on record through eBay messages that the package was in perfect shape when arrived. Ideally, get the packaging back in person and you can take a pic of the weight. Therefore, one can reasonably conclude that the recipient is the only one who opened it (could be someone else in the household though, but either way, item was delivered).

    I do not mention or hint at these suspicions in any way to the buyer. Be professional with them. Bring up the issue with eBay. I've won this way.

    There's also insurance or some of you consider self-insurance as the better option.

    Unfortunately your policy is void as it is overridden by your user/seller agreement with eBay. eBay WILL refund the customer and debit your account in the event a buyer files for a return regardless of your displayed policy in the listing description. I tell you this to help you, in the sense that you may think you are protecting yourself by SAYING you have no return policy, but know that eBay FORCES you to honor a return regardless.

    You know, I got an opened package once. Seller didn't tape the end shut on a manilla bubble mailer. I opened my locked mailbox and there it was, mailer wide open. Seller asked me to open a case with the Post Office and see what happens. Nothing happened and seller refunded my money. I left 5 stars for making it right and good communication throughout. I probably got banned but I think the seller mostly sold comics and sports cards. Open packages aren't always a scam. Check, a recent lot of tokens I just received has an extra one I didn't pay for. I contacted the seller and told them I would send it back...haven't heard back yet (I need their address because I threw out the envelope before checking).

    As a seller, one should completely seal a package, so there's no way it would be accidentally opened en route. I'd also ask the buyer directly if there were any openings, pics, etc. With a buyer's response of no to an unopened package, under those conditions, it's highly improbable that it's an empty package. With that said, I can see how improperly sealed packages will open up en route.

    I traded some coins for almost a pound of 90% silver quarters back in August of 2013. He received my package as scheduled via tracking. My package was tied up in upstate NY for weeks. I call them, gave the tracking number and they couldn't find it. A month later I see the package is going back to the guy I traded with. I told him to send back my stuff, which he did but didn't package it well and some coins where damaged, but I'm glad to have my stuff back.....
    February 2014 I receive an empty padded envelope with nothing reinforcing it. So he just dumped a bunch of loose quarters into a padded envelope, so of course it would rip. It was an expensive lesson on his part.
