Packages rarely get lost in the mail so odds are that the seller is using the lack of tracking as an opportunity to rip off the buyer.

I think it is despicable that this buyer lied in order to smear the ebay.

He said the seller never responded, then later showed communication from the seller.

Once you lie, it's all over.

The basic issue here is that this individual has had far too many problems to be given the benefit of the doubt anymore, and this may not be as straightforward as it appears. If he indeed returned the coins, he should get a refund, by money order, but at the seller’s convenience. However, since Timmy could not be bothered to spring for tracking, I guess we will never know if the coins were actually sent or if the seller received them.

Of course, the OP also should have contacted the seller prior to bidding to ask if he was willing to accept his money order instead of, as always, believing everyone should cater to his every want and whim, but some things will never change. The point is that it is unfair to place all blame on the seller when the buyer did his fair share to make this a highly questionable transaction from the start.

Recently, the OP announced that he was going to keep two books that do not belong to him because the other party did not play by his rules. Now, he chooses not play by the rules but still expects everything to go his way. Perhaps karma is finally catching up with him.

It seems that both parties are at fault. The seller should have explained the item description more carefully and unless stated that the photo is the actual coin or coins then the seller could be just using a stock photo for multiple lots. Even though the seller should have had the right pictures uploaded they did state the dates in the description. Also the seller should have replied to you as soon as possible on the matter instead of holding off. Now as for the buyer? Always read and view everything closely and over and over. If the description and item picture do not match up then the best thing to do is point this out to the seller until the problem is fixed and new pictures are uploaded and if not then the item shouldnt be bought or bid on. They probably went with the seller because a buyer should have caught this in the first place as they see it. Also did this seller have any return policies? If they state that there are No returns then most of the time it is what it is unless its tied to fraud and fakes but then ebay will stop their listings anyways. On a curious note... by any chance did you have check this sellers ratings to see if he had any other feedback that fit into this case?

Hmmmm. The listing was titled "Lot of 33 sixpence coins from 1950's" yet pictured coins from the 40's. Tim was hoping the seller made a mistake and bid enough to win the lot yet when coins from the 50's arrived, chose to return them:

    Without communicating with the seller
    Without proper tracking

TIM, if you're going to play the "on approval game" learn to play by the rules. It'll make your life easier.

Now, if "I" see what appears to be a cherrypick and bid a listing up to insure that I win it and then it turns out NOT to be a cherrypick, I NEVER, EVER, return the coins as its MY error, not the sellers.

Tim should have contacted the seller and simply asked if the coins would be from the 40's (as pictured) or from the 50's (as described).

While some of these comments have been too harsh towards Tim (IMO), the above quote is dead-on accurate. As an eBay seller, I can't stand all the buyers who think this is "show and tell." That kind of garbage is a waste of my time and efforts. (I know, I know, it comes with the territory...).

Absolutely, and while it may come with the territory, this does not make it right.

But if you ask a question, isn't the question and response posted in the listing? If so, it might call attention to your "pick".

Time to email the seller a "polite" message. Those ARE the ones I received and returned..

Well it appears that there was a misunderstanding. Since eBay said they refunded me (which they can't because I don't have paypal), he assumed they mailed me a check or something.

He also said some members on here emailed him and said I was "trashing him". Look. I know who these members are, and quite frankly I'm a big enough man to take care of my own issues, thank you.

Much ado about nothing... big surprise.

Does this mean you've learned a lesson and next time will do the right thing by asking the seller if they will accept your money order as payment before bidding?

Frankly, you deserved it (and no, I am not one of the members). You lied, made false accusations, and placed all blame elsewhere instead of admitting that you played a part in this mess... sounds like "trashing" to me.

If you're a big enough man to take care of your own issues, why do you feel the need to run here with every problem, real or imagined? I've said it before, but if you choose to air your dirty laundry in public, and stick your nose into other people's business, do not get upset when people listen or stick their noses into yours.

I am glad this worked out; another world-ending crisis averted.
