As a final update to my case, eBay has reversed their original ruling and will issue a refund on the item. Since it was several hundred dollars, I must say I am very pleased with the outcome. No doubt the letter from the Postmaster had a lot of influence with eBay's decision. I feel much better now. :>)

Thanks green. It's one of those things where you know you are right and you fight to get it correct. I'll give eBay credit for the honest effort they gave it when I appealed the case. I have a feeling that they just might be eating this and not taking the sale back from the seller either. You would have to read all the correspondence, and their final letter to me, to understand that statement. I'm starting to believe in their eBay Buyer's Protection. This was the first time I put it to the test.

An update to mine as well. The seller let me know that their neighbor came over with the package as it was mistakenly dropped off there. Very honest and will resend the refund I gave.

Was it over $250? I though $250 and up required signature confirmation.

That's great... I know that kind of thing can be nerve racking.

I am glad it worked out for you. Sometimes, the hardest battles are the ones that you know are for the right reasons...

The longest fight I had with eBay was over a 6-month period...

I won an expensive coin, but relatively cheap compared to catalogue prices from an eBay seller (whom I no longer do business with). He tried to cancel the auction and I said, 'No, send me the item'. The seller had also advertised free shipping. So a registered package came, with signature required... except the package, which was completely sealed, was empty!! Of course, when I complained, the seller said the item was sent and he had 'proof of delivery' with my signature.

The package felt alarmingly light, and I had taken a video of me opening the package, revealing it was empty. Yet, it took several months of back and forth emails, phone calls, etc... before this was finally resolved in my favour. I learned my lesson from this. The next time if that happens, I will file a case with eBay, saying item was 'not as described' (I didn't want the invisible version) and send back the empty envelope, with proof of tracking and signature....

SSP Ottawa: That was very smart to take that video. Otherwise the circumstancial evidence would have been impossible to overcome. In a case where I think the package is empty, perhaps I would take it to the post office and open it there. It shows what obstacles both buyer and seller go through when dealing with someone intent on fraud through the internet. I have a limit of $500 when purchasing anything on line. Maybe I need to reduce it further to $250. This would give me one more reason to attend coin shows or buy from B&M dealers to begin with. You can't always rely on third party decisions to work out correctly. Congradulations on your persistance.
