Should I pay this guy on eBay?

I really screwed up this time. I take sleeping medication (Ambien) and am completely out of it on the med. I have actually been known to sleep walk. So the other night I was apparently on ambien and was doing shopping on eBay. I woke up the next morning to see that I won 3 auctions to include a 1928 20 dollar bill. It was about 200-300. The thing is I have no clue about these auctions and feel like it was beyond my control. The other two auctions were fine with it, but it appears as though the guy from the note wants his money. He ignored my message to him and said something like "you won the note" I actually feel terrible for the entire situation but don't feel as though I should pay. What are your opinions?

When you bid and win, its a contract with the seller that you'll pay, so I would pay for the items.

Many of the items on eBay are sold in an auction-style format where you can make bids. Bidding is a lot of fun, but remember that each bid you make is a binding contract to buy the item if you win

Ask if he is willing to offer the note to the next highest bidder. You should pay for the note if he cannot sell it to the next highest bidder. If you decide not to pay him, the worst that can happen is you'll get a non-paying bidder your account. Hope you can resolve it peacefully!

 

1. Put a CAPTCHA style password lock on your PC to avoid "sleep bidding" in the future.

2. You obviously don't want to pay for the bill, consider offering the seller a few bucks to cover his eBay fees. If he won't accept it, let him do the next step, nothing bad is going to happen if it's the first time this happens to you. If it goes to eBay support, you can always show them your med prescription scan and hope for the best.

 

Yes, I think you should pay. It is not the sellers fault that you decided to shop on ebay while drugged up.

 

For a contract to be valid you must have capacity, consideration, agreement, and legality. If you were on Ambien and bid because of it, I think it would be easy to argue that you did not have capacity at the time of the bid. Therefore you do not have a valid contract. Based on what you said I would not pay him, but I would provide proof if requested, and I would put a password on the keyboard so it does not happen again. Since this has now happened once it would be hard to claim it in the future if it were to happen again.

I completly understand that you are out of it when you take your medication, my mother-in-law lives with us and takes it and she will just be up doing whatever and never remember a thing from when she is on her medication.

Having said that, you know this happens and you are an adult, responsible for your own care, so in my opinion, either you take measures to prevent this kind of thing from happening, or you pay for the biddings that you won on your medicine.

Tell the seller you want to cancel the transaction. He will send you a form.

If the seller won't comply, then simply do not pay. However, you will receive an unpaid item strike.

Some sellers will not let you bid on an item if you have 2 or more strikes, so one is not going to hurt.

Don't feel bad, my dad used to sleep walk...years ago he walked outside in the nude, and locked himself out of the house! Imagine how embarrassing that would be!

I would ask the seller to offer it to the next highest bidder at that bidder's price and I would pay the difference. If he said no, I would pay it. "Did not pay" follows people around.

You should tell your doctor about the Ambien reaction. the journals have records of people getting loopy and instead of eBay, they drive, sleepwalk, and even take the rest of the prescription bottle. One of my nurse friends emptied a brand new bottle of Ambien the first day she took one. She was unconscious for 2 days and laid in her vomit ( lucky , as she threw up most of it).

 

Yea Ambien is nasty stuff. My sister in law took it, was naked in our living room yelling and talking to herself. My wife called an ambulance for her because we didnt know she was on it.

Just ask to cancel the transaction in a courteous way and do what you can (some good suggestions have been posted) to avoid this happening again. Not really such a big deal. I'm disappointed myself that Ebay has eliminated the 3 day return option - it was so civil. Two weeks is impractical with coins that have value that is substantially related to the precious metal prices - EBay is a great resource, but I wouldn't take the "contract" stuff so seriously. Be nice, communicate. If the seller doesn't return the respect - that's their problem.

And once the note is resold, close your eBay account. Don't bother opening up another.

Are you on Ambien right now? Did this even really happen or are you actually dreaming that you bought something while you were sleeping and then posted about it??

 

ask if he can sell it to bidder #2 and offer him $20 for his troubles.

If this really occurred, and you fault the ambien medication, I would take pre-cautions so as not to repeat this situation. Unplug your computer at night and put away the cord. My take on this is that this situation puts you in a financial dilemma . Request the Seller to consider the facts and ask for their consideration. If they choose not to cancel the transaction, I would suggest you honor your bid, if possible or suffer the consequences.

 

However, he can't be held responsible if he's under the influence of medication like a sleep aid.

JB, if you're married, I would have your wife hide the mouse to your computer, and maybe even the router so you can't connect to the internet after taking your meds.
