A Little OT, but a big THANK YOU to my attorney Duane Blake!!!

    Look what just came in the mail!!! I'm very excited and very thankful to a fellow forum member on the CU forum "Duane" (Duane Blake) for being so talented and working very hard in obtaining the trademark for "Penny Lady"! It often can take a couple years to process a trademark, but Duane got it finalized in 8 months! So now that I "own" the Penny Lady name, I can use the little "®" following my company name.

    Despite the fact Duane is a lawyer:)devil:), he is a great guy. He always has time to talk coins and somehow always manages to find outrageous toners.

    Does this mean anytime we mention the Penny Lady, we're going to have to pay her royalties? If we don't, will she sue us for Trademark infringement?

    Seriously though, in addition to adding value to a brand, I believe that trademarking a company name can be an important protection to that name, and I am very pleased that Duane was able to accomplish this so quickly and painlessly!

    Just as an aside OP, there could still be people DBA Penny Lady who registered as a DBA with their local county. Counties usually don't check Fed registrations, so there could be a chance you will run up against the name sometime. If they registered after you registered Federally, the county will usually revoke the DBA. If prior, you may have to do a little work to chase them away from the name.

    Just a point to remember. :) Gratz.

    medoraman, thank you for the information. FYI, in my past life, I was a litigation paralegal and specialized in patent and trademark litigation, and know that as an owner of a trademark, and in order to maintain that trademark, I am required to be diligent in protecting the name against anyone who may be using it. So I have already done a lot of research and am aware of who might be using the name in relation to coins and am taking appropriate steps to protect my trademark.

    Great! Glad to hear it. I just wanted to post about it just in case, and also in case anyone else here was going to do the same.
