Nothing says people have to buy from that seller.

I wouldn't. Especially since you can find those same year and mint Washingtons for around melt, in those grades.

 

Its a free country and folks can title their listings anyway they like on eBay as long as it does not mention a specific numeric coin grade on an ungraded coin.

It's up to the buyer or potential buyer to "read" the listing (along with the Terms of Sale and Shipping Information) before slapping down a bid.
