How long do I have to file SNAD with eBay??? Important

    I recently purchased an 1889 cc off of eBay for $585
    After receiving it, I sent it to be graded and it came back as altered mintmark
    I contact seller and he says nothing I can do because he doesn't accept returns.
    So how long do I have to file a SNAD under buyer protection? How long am I legible, I'm afraid he knows I can no longer file so he won't resolve issue now.

    I'd file one NOW, regardless of time taken for grading.

    File with ebay as well. You will need to be on the phone with these people, though. I personally don't know what kind of time, but file with both IMMEDIATELY. Unless it's been over a year....

    i would file regardless, there is a paper trail AND regardless of his "no return policy" ebay does not honor such a thing if you are persistent about it being altered..

    Altered = fraud if it wasn't described as such. He led you to believe it was the real deal. File immediately.

    Agreed.....the buyer is always right. Regardless of whether a seller says 'no returns'. you can bet that ebay, OR Paypal, OR both will side with the buyer on something this bad. ebay has become 'seller beware'.

    How long HAS it been, since auction ended until you got it back from grading (and which TPG, if you don't mind my asking?)?

    It's been 48 days since auction closed till yesterday when I received the coin back from Pcgs
    Suprisingly I sent in a 1884 S that I thought was cleaned/retoned. She came back a solid gem 62.

    But back to the point I know there's a number of days limit until I can file a claim afterwards I no longer can, how long is it?

    I'd think at least ebay would make good on it, if not Paypal, outright, due to PCGS being an ebay accepted TPG company. File it immediately, and definitely make follow up calls. I believe you have time on your side, but not 100% sure. If the seller said 'sorry', discontinue communication with him....let the powers that be do theor thing, and remember his attitude when it comes time for feedback.

    If you are unsuccessful with either an eBay SNAD or paypal dispute, then file a case with the Internet Crime Complaint Center and since (I'm assuming) the United States Postal Service was utilized, file a case with the United States Postal Police. It may take a while, but that should do it.

    McBlzr.....45 days....and it took 48? Daaaaaaayyyyyum..... How was it paid for...Paypal with a CC? That might be your only way out.....if not with a CC, then for 3 days, I'd be on the horn with PP and ebay.....they probably won't allow an online filing.....3 lousy days.....ouch.

    It sounds like it'd be fraud either way and not limited IMO but that 45 days might be extended from when you recieved it per:

    "You did not receive the item in the estimated delivery time provided on the Order detailspage (or 7 days after payment, if no estimated time was specified). We may lengthen this period when necessary, for example based on the type of shipping provided or the buyer's location"

    Actually, I could see this going longer than the time eBay allows to file, so I'd give Negative Feedback immediately, also.

    Unfortunately the seller was timely
    He shipped next day, stated handling time was 4 days.
    He shipped priority first class, listing stated media mail.
    He also had it shipped with signature confirmation

    I really do think it's past the 45 day mark sadly...

    Personal experience with IC3
    They do nothing unless it's over a certain amount.
    He may be watched but no biggie seller will switch address

    I'd file it anyways. BTW, did you let him know up front that you would be sending it to be graded? What is his feedback like? Has he had any negs in the past?

    When you're buying a coin and you're having it graded, I think the time involved could possibly be longer, don't give up just yet. File whatever until the dude sees that you're dead serious about wanting a refund!! Now, good luck!!

    Oh and don't be giving up the dude's name on this forum, at least not until the fat lady sings!! :D If you need to tell someone the seller's name, do it in a PM. :thumb:

    Dunno guys, this one might be bad enough to take it past Ebay's protection policy. Perhaps since it was sent through the mail system it would be considered mail fraud.
