What exactly does the government have to gain by doing this? Aren't their more important issues at hand than seizing play money? Like you know, the economy, the war, illegal immigration or, finding money that's actually counterfeit just to name a few examples.
I would suggest that if the government is seriously worried that US currency won't be "acceptable currency", then they (we) should START PAYING THEIR (OUR) BILLS!!! ...and leave poor Benard von Nothaus alone.
The idea was to start bartering with the Norfeds and that's what happened. The fact that you or I don't see any in circulation doesn't mean that much because we don't live in one of the State's that they were traded in. If you had been in Idaho during the busy period then you may have gone to a restaurant, gas station, chiropractor, gun store and you could have traded with them. It didn't get very far because all they had was an idea and a list of companies that were willing to barter in that manner. It happened but it was a very revolutionists idea that didn't go over too well with regular citizens. Only the militia types had the cajones to use them, not even the Tea Party wanted to use them altho they support other forms of payment. Me and you were in the wrong circles that's all. But you can buy them if you want.
I understand you can still buy just about anything you want in Idaho for a truckload of manure. :dead-horse: I guess not stamping it with "One US Dollar" is the key. :thumb:
This is a really good video put out by LibertyDollar.org before they ran into so many problems. The video even talks about the commerce that was going on in Arkansas. Anyways, Von Nothaus was saying the commerce was nothing to worry about and I think he was right and most likely could have succeeded if he wouldn't have made his dollars look soooo much like a US coin. Anyways, you decide, it's an 8 minute video and it's actually very good and Bernie and his crime partner didn't think they were doing anything wrong at all. Terrible, he had a great idea but made some huge mistakes. Great looking coins tho'!! Oh, I forgot to mention the first video was made in 2004. In 2007, in the bottom video Ron Paul talks about the bust. Enjoy! http://www.youtube.com/watch?v=eYGDVUb8MjA http://www.youtube.com/watch?v=XhWRDP8v9ss&feature=related
This case is under appeal. There are Constitutional issues raised by the points made in this trial and the very laws cited above could be tossed out because they deny the defendant his rights as defined by the US Constitution. The jury who decided this case was not asked to consider that issue. Congress has passed plenty of laws that were later found to have denied people their rights. IMO, there was some signigicant new legal theory created by the prosecutors and that theory will have to be sorted out at higher levels in the court system. There are already plenty of examples of alternative currencies in US history that would serve as precedent to throw out the case.
Good luck to him. If I were a betting man, I wouldn't want to risk much. There are a lot of lawyers at this site that would be glad to let you know what Von Nothaus' chances are: http://www.quatloos.com/Q-Forum/viewtopic.php?f=8&t=5652
That's like saying that the police shouldn't waste time on those who run stop signs when they should be handling more important issues like speeders, reckless drivers, robberies, murders and the like. It's all part of the whole. What the government gains is a reaffirmation of their right to be the sole issuer of currency and to send a message to those who think otherwise.
Nor would they ever be asked to do so, nor should they ever be asked. It is never left up to a jury to decide if a law is constitutional or not because they, the jury, do not have the wherewithall to do so. Only the courts, the judges, can decide that.
