I sold a coin on ebay, I have a no return policy. I dont grade the coins i sell, I simply just list the coin as what it is. I have a buyer who opened a item not as described case against me because he doesnt like the condition its in. Will I lose this battle?

    I sell frequently on ebay.

Was the item he/she received as you described it? As long as your doing your due diligence as a seller, you shouldn't have anything to worry about. You will, however, have to think about your feedback. Even if he/she is in the wrong, they won't be happy with you.

This was my description. 1926 Peace dollar, guaranteed authentic.

Well, since ebay tends to be a more buyer friendly place than a seller friendly place I dunno how it will play out. I do both. Your description seems fair. Its a coin and its real. What is his issue with the coin? Is he stating that the coin isnt real? Or that it isn't a 1926 Peace dollar? I mean if you didnt state that it was in super awesome condition or give it a grade then I'm not sure how much of a leg they have to stand on.

In all my auctions I put ALL SALES FINAL. I dunno if that would work if push comes to shove but it makes me feel better.

Pick up a phone and call eBay. They are usually surprisingly helpful. REALLY!

Since you basically got no description, the photo might help determine if the item was as described. Was there a photo in item description? Was it edited in any way to make the coin look different?

It is all very subjective, even the slightest light reflection unintentionally hiding a scratch might turn into a case.

He is say there are scrathes on it, that did not apear to him when he looked at the pictures. It wasnt sold at a high price, I was trying to pass it off as something it wasnt.

    Remember eBay's policy on returns:

Sellers are always required to accept a return if eBay determines that the item was significantly different from what was described in the listing.

So if eBay determines your item is SNAD, you must accept the return and refund the payment. And since they (eBay) heavily favor the buyer, you might just have to do this. Plus there's the threat of negative feedback (and you, as a seller, cannot leave any feedback except positive). Personally, I would rethink your return policy. Buyers often avoid auctions that don't have one, and if they do purchase something from a "no return" auction that they're not happy with, are forced to open a SNAD case.

100 % percent You will lose a battle on this, even you won his money not to give him a REFUND. You will get on his NEGATIVE FEEDBACK that will ruin your reputation as a bad seller. My advised send him an email that you will refunded his money as soon you recieved your item that he won. BUYER IS NOT HAPPY...

Just curious, was the picture in the listing of the actual coin you sold, or did you use a picture of a different coin?

Wouldn't it be just easier to give a refund rather than putting you and him through the hassel of what you are about to go through with ebay?

I probably will end up giving in. I just wanted to figure out how things work.

It seems unfair that bascicly you can buy a coin on Ebay, make the seller pay for shipping, look at it, and return it. So i can buy coins gets a closer look then return it.

Sounds like the buyer might indeed win this one... Are there scratches that are not in the photo? You will know the best since you saw the actual coin AND the pictures...

Not sure if it is still possible, but partial refund could have solved this mess, plus if you do this right, there can be positive feedback. Its all about communication.

As strickly a buyer on Ebay! And I make a lot of purchases! I'd say that as long as the coin that was in the description was the one you sent you should be fine! If you did send a different coin you may be in trouble!do you have a link to the site! If so please post it!

There is pretty much no such thing as "no returns" on EBay. I have found that offering a no questions asked return policy makes your life...and feedback much better.

Well since the cards are stacked against the seller I always say returns accepted if not happy, buyer pays return shipping and must agree to cancel the auction.

Only had one return in the last three years and got a postive feedback on it. And yes I got my fees back too and sold the same item two weeks later for more money.

Coins seem to be an area that going with the flow and letting the buyer be happy seems work best.

Having experienced this exact situation, I can say that the buyer will "win" the argument in that they will be able to leave you a negative feedback and you will be powerless to do anything about it. However, if you stand your ground and believe you're right, and your description and photos were sufficient (I'm assuming you don't want to send money back...) you'll keep the money. And the negative will come off your feedback percentage after a while.

I know this because I had one of those buyers who did not even look at my ad (apparently) and then tried to blame me for it. I stood my ground, he gave me a negative feedback and sent me threatening emails riddled with spelling errors, and I communicated this with eBay - only to have them say "there's nothing we can do." I did, however, learn that you should wait 24 hours to leave your feedback rebuttal. What doesn't sound whiny and unprofessional after a cooling off period won't sound that way 6 months from now...but words uttered in haste (that seem reasonable at the time) have a way of sounding bad a week later to you....and you can't take it back.

    Just my two cents.

FYI, all my auctions are currently 'no returns unless significantly different from the coin pictured and described." I haven't had too much trouble finding bidders - but then again, I try to do everything in my power to take good photos and describe anything that doesn't show up in them.

    Right !

More importantly... it's the right thing to do. I strongly believe I should do for others what I would want them to do for me. If I got a coin I was unhappy with, I would want a refund. It's totally reasonable.

Refund. It's the right thing to do.
