Another ebay scam-artist-- please advise!

    I'm sorry you got taken but I really don't see anything wrong or actionable in that auction. Yes there is probably some real hype in the description about the source of the coins, but I see nothing wrong in the description of the lot itself.

    And it says he was IN two world wars, not that he SERVED in two world wars.

    Doesn't imply anything, you inferred something not stated. He sid there at least 24 or 25. You said there were 26, so he told the truth. The fact that the ones not shown were culls doesn't matter.

    Does he say they are still in the collectors 2X2's?

    Now here you might be getting close, but he doesn't show the tops of the boxes, and they are apparently fairly new if not brand new boxes. The collector did not die "Years ago", it says he died in 2009. Could he have labeled the coins? Maybe, or as I suggested the seller may have reholdered them. You do say the writing on the holders matches that on the shipping box so that is a possibility.

    The only real claims he makes is that there will be at least two silver coins (True because there are two in the pictures), that there are at least 24 or 25 coins from the 1800's (True, you said there were 26), one of the silver coins was an 1879 (True, it's in the pictures), and that that coin is choice BU (Now here you have something because from the picture it obviously isn't). He says it has a choice BU 1932 Peso (It has the peso, but it isn't BU). Has Swiss coins from the late 1800's (True, at least one in the picture.), Has a Spanish coin from 1877 (True, in pictures but they don't "look new"). Then you have where he says "I have seen those before and I know they go for $30 to $40 each." That MAY be true but only in a sale to someone who doesn't know what he is buying.

    Overall I'm sorry to say you don't have much of a case. You were a victim of a carefully worded sale and your own greed hoping to get something for nothing. You got pretty much what was described and you aren't happy you didn't get better.

    Where do you think I got the coins for my foreign collection? Did you read the part of my post where I said I usually remove them from the original holders and put them in my own. I've never left the US. I purchased them from others. I mentioned this to show that the just because he said he got them from someone, it is posssible that he put them in new 2x2's. This does not constitute "fraud". If you bought these coins based solely on the tale in the narrative, rather than what you saw in the photos, well then... Because it really doesn't matter where this guy got the coins, does it? Sentiment really isn't worth much in the long run except to the sentimental person.

    How am I being "jumpy" about this? You made a post, and I responded. The fact that I didn't stroke your hand and tell you what a horrible, evil man this seller is, is because I think (and isn't that why you posted, to see what others thought, or were you simply looking for sympathy because of a bad deal?) that you got over-excited during the bidding process and went way beyond the actual value of the collection. Keep in mind YOU could have stopped this deal at any time by simply NOT BIDDING ANYMORE.

    Don't be offended. We all have made mistakes, some costly, but we learn and move on. I apologize if I didn't tell you what you wanted to hear. I simply offered an opinion based on what you said, and what I saw. You threw some pretty serious charges out that, if unfounded (and this will be proved or disproved through investigation, like you said) could get you in pretty serious trouble with eBay yourself.

    As I am just catching up here, I presume you are the " Seller " in this Auction. I'n not taking anyone's side here but I would like to offer a suggestion for you.

    Amicably , refund the " Buyers " money . You both , I hope have learned a thing or two by this situation. It's is senseless for either of you to be stubborn or even feeling victimized . For you both, it's to no one's advantage to be " unmoving " in this resolve. Time to act like Adults and Professionals . I'm fairly certain that neither of you, will ever have to confront each other again. Each of your attempts to embarrass the other , has failed miserably and to further in this manner is simply childish at best .

    Your presumption is wrong. In an earlier post I stated I do not use eBay. I am not the seller in this instance.

    Everyone wants a bargain and many want to offload junk. Clashes are to be expected. I learned the hard way also. Now if there are no returns accepted, I don't bid. There are very few legitimate reasons not to take an item back IMHO.

    That my friend, is the best way to protect yourself on EBay. It's my #1 rule for buying coins off EBay.

    Directly from eBay's return policy:

    "Note: Sellers are always required to accept a return if eBay determines that the item was significantly different from what was described in the listing."

    I doubt if this auction qualifies as SNAD; however, eBay will usually side with the buyer if their is any reasonable doubt that the item received is different from what is described.

    Sorry but I'm not seeing fraud or any type of felony. Not to judge the seller but he did add a bit of hype to the listing. Sounds like he sent what was listed. I feel the bidders lost control and drove the price over the lots value. Tough lesson but it comes with coin collecting and buying on Ebay. Hope you find something in the lot that makes the deal seem better.

    NOT BIDDING ANYMORE?? The bid history shows that the winner placed a bid at 08:22:33 with the auction ending at 08:22:37. Looks like a snipe to me. I wonder what that snipe amount was for? To me,
    this clearly looks like "buyers remorse" seeking the support of the CT members for bidding irresponsibly.

    As for the OP, just file your dispute with eBay and they'll cover your but however, do NOT threaten a negative to the seller or eBay WILL decide in favor of the seller. You do have a right to return something you don't want or that did not meet your expectations but eBay's policies clearly state that feedback extortion is against the rules. If you break ebays rules, they'll not support you as a buyer.

    I fall on the side of the seller in this sale. Unless there is an particular item mentioned you should assume there is nothing of value in a lot. A buyer should have bid on the 16 coins showing and about 200 other garbage coins. If you expect someone with a title of notesandcoins2010 to not have a good idea what is in the lot you are crazy. They have done over 1000 transactions, if there was something else of quality in the auction it would have had an auction of its own.

    Well, I sent a 'one-off' Ebay email to the seller, advising him I'm thinking about taking litigation and securing compensation against him, after I spit hot coffee through my nose , when I read about the 2 year old that got deployed into WW1.
    My take on this whole thing?..I dont trust lot listings of this nature..and I don't care if it was listed by a Catholic Bishop, or the Pope himself. I stay clear, and shake my head in amazement with item descriptions of this nature.
    The sentence structure of his listing, look like a grade 4 level.
