alert goverment refusing coins for payment

    To whom it might concern;
    I was given a speeding ticket in Gauley Bridge WV. The constitution provides for the town to control speed limits. The constitution also says I can pay with Change "legal tender" as described in THE COINAGE ACT OF 1965 section 31 USC 5103. When I tried to pay my ticket within the thirty days the town allows, the personnel at town hall refused my money. I contacted the town prosecutor which is also an assistant county prosecutor about my problem and he said he wasn't going to do anything about the violation of my rights. Since then I've been in touch with numerous State Senators and Delegates, US Senators and Representatives, the Attorney General, and I've also contacted the Governor, and no one seems to want to enforce the US and WV Constitutions. Any departure or violation of the constitution is subversive to good government "WVC Article 1 section 3 " the constitution also states that every person elected or appointed to any office takes a oath to uphold the US and WV Constitutions "WVC Article 4 section 5" The chief executive power shall be vested in the governor, who shall take care that the laws be faithfully executed "WVC Article 7 section 5" Any person elected or appointed to any office who does not uphold the US and WV Constitutions is guilty of neglect of official duty "WVC Article 9 section 4" It might seem trivial, but it's important enough to be part of the constitution.

    I`m curious as to how much and what You tried paying with?......A $250 ticket to be paid in pennies? Either way I would have loved to of seen the look on their faces when You tried to pay in change. : )

    150.00 fine 60.00 in pennies the rest in nickles,dimes,quarter,halves,and ikes. the clean parking meters out but refused mine spread the word

    I would have done the samething. whats the purpose of making coins if we cant use them?

    Are pennies,nickles, dimes, quarters legal U.S. Currency? Do we get them in change for nothing. That would tick me off. Heck! Im ticked off about hearing this. Why dont they throw away the bill of rights and institute the Communist Manifesto, and while they are at it, do away with the $1. No one uses them anymore right???? Give me a break. If I ever get a ticket, fine, or any debt to the local Gov't I WILL pay in coins. As a matter a fact I'll use only pennies, unrolled and in ziploc bags!!!!!!!!!

    This is a direct violation of your rights being a US citizen. The a simular thing happened in the case of gideon vs wainwright. This guy was accused of breaking in to a pool hall. He went to local court and asked for a lawyer. They refused, and sent him to prison for 5 yrs. During the time he wrote the Supreme Court. They ruled in favor of gideon to be represented by a lawyer.

    all i can do is spread the word to let everyone know whats on the way i guess when they stop using coins we will have to collect old credit cards

    I think if i paid a ticket in small change i would have at least rolled it.

    I did however pay a $66 fine in loose golden dollars.

    I had it in coffee cans in fact it's still here with the ticket waiting on them

    Isn't it cheaper to not be so petty and just go to the bank or grocery store's customer service counter to redeem your coins for paper money or a money order to use to pay for your ticket, rather than possibly needing to pay for legal services or fooling around wasting civil servants and local government agencies time, which you are also partly paying for via taxes?

    I believe they can refuse unorganized loose change in quantities such as yours (tin cans). Give them rolls of cents, I believe they must take rolled coins, as it is reasonable, and countable.

    I could be wrong, but I think the "legal tender" proviso is only if a debt is already incurred and a payment is being made on it. Since most traffic tickets are a choice to pay a dismissal fee or go to court ( after paying bail fee), I suspect they are correct. Until you choose the "pay dismissal fee", you have no debt, just a judicial choice of incurring one. Once you say you will pay the dismissal fee, the debt and payment will occur at the same time and they can specify what they will accept. This is a privilege given so merchants and others do not have to maintain coinage and paper money for all change giving purposes. JMHO.

    according to the "coinage act of 1965 section 31 usc 5103" a business can refuse but a town is goverment you know the that make the money, i think they have to accept it thanks for the info

Beware of going through this town with out of state plates or even WV plates if your from out of town. They have two officers that are brothers, who were fired from Summersville, another known speed trap. They will say you are speeding even if you aren't. Many forums have posts from hundreds of motorist that say they were not speeding, but cited anyway. For more information on the Speed Trap, simply do an internet search for "Gauley Bridge Speed Trap". You will find out all about the Whipkey Brothers and Judge William Kincaid. The Judge will not even let you present your case and finds everyone guilty who contests a ticket. Go to Google Street View and take a virtual ride through town on route 39. The Google street car even got pulled over! They are crooks, and a simple internet search will help you understand just how many people are being railroaded in the old depot (City Hall) at Gauley Bridge."

    This is pathetic that the state of WV allows this crookedness.

    I'll avoid the whole state.

    Sux....Pay the freakin' ticket and move on. Ain't worth the hassle and you'll incur more in legal fees than if you just paid the little **** ants off......
