Ebay Presale: Better to Chargeback or open an Ebay Case?

I'm not sure if this is the right section for this, but it seemed the most general. I recently purchased a presale item on Ebay for the first time and it looks as though the item is not going to ship within 30 days after the purchase date, as required by the policy.

I assume the best course of action is to contact the seller to get a refund. If that doesn't work, would it be better to chargeback the purchase through the credit card company or to open a case? This is my first experience with this, so I would appreciate some direction from those of you who are familiar with this type of situation. Thank you.

I was under the impression that pre-sales were verboten on eBay.
If the seller won't refund, just file a claim with eBay. It's a simple process and, based on the facts you supplied, you should get your refund promptly.

Yep. If the dude don't ship in 30 days then he messed up. He shouldn't have been making promises he couldn't keep and by rights people need to open a case. Everybody knows that pre-sales are not allowed and he deserves the stress for stepping over the line.Click here to enlarge If you want to do business on ebay you gotta be a stand up guy, if not then you get a terrible feedback score and buyers stay away from you. It's not rocket science, we all learned this stuff in grade school.Click here to enlarge Bookem' Dano, I'm just sayin'!! Click here to enlarge

Request refund first, if he won't refund then open a dispute. If the dispute doesn't work then do the chargeback.

Chargebacks, even when obviously justified, tend to sour your relationship with PayPal. I view them as a last resort, and while I always use a CC to pay through PayPal, I've never had to do a chargeback -- Buyer Protection has always come through.
