eBay seller threatening to take me to small claims court over feedback?!?!?!

    It appears to be the same coin with A LOT of juicing to the pictures. I wouldn't worry about the threats. Contact Ebay(like you're doing), send the coin back w/signature delivery and get your money back.

    Yea, we discovered that in the other thread. When I first got it I didn't even really look at it, I seen the color and thought it was a different coin.

    Here's that thread from the day I bid on it, to when I got it.

    1909-S Lincoln Wheat Cent AU or MS

    Yea, I contacted eBay. They told me we should have worked inside of eBay before saying anything about court(??) I filed a not as described claim on the item, waiting to hear back from the seller. She did tell me that since there was nothing wrong with the negative, and only says that the item wasn't as it was stated, it doesn't have to be removed. I'm sure he's not going to be happy about that.

    So hopefully the return process goes well. Cross my fingers!

    Same coin taken with flash and probably altered colors with photo editing. If money isn't an issue then he should have just refunded you.

    You could report it to ebay. But in all honesty, the coin you received looks much better than described. He pegged a grade around a VF, yours looks to be a top shelf XF with a shot of an AU brown. His auction photos gives off the appearance that the surfaces look played around with (cleaned) because of it's unnatural color. But I don't know, these are my up front opinions. Does anyone see what I see?

    As to why this seller would send You a previous email to the losing bidder?.....Idk, perhaps the losing bidder was somebody the seller was having bump up the auction. (We all know it occasionally happens on ebay) If he knows the losing bidder, what difference would it make what jibberish he told him in the email?

    I agree with what most have echoed already....I think he`s trying to punk You.

    Why does he keep insisting that it's the same coin if the only problem was poor representation? Could there be some level of miscommunication, or....?


    This makes no sense, BT. Claim or no claim, you want to return the coin and get your money back, right? So what's the difference? If he gets the coin back and chooses to use the same photos, he will. Short of keeping the coin, I do not see any way that you can stop this from happening.

    As for the feedback, unless ebay refused to refund you, you didn't "waste $200!!", so why say such a thing, especially before you've even filed a claim? Chances are that when said and done, the only thing you will have wasted is time on what was a rather questionable gamble to begin with. You should have simply filed said claim and waited for everything to be worked out before leaving feedback; if the seller truly believes that he is in the right and did nothing wrong, how did you expect him to take what you said as anything other than the attack it was? Please understand that I am not trying to defend him, his customer service, or professionalism in general, but just as he could have and should have handled things differently, so should have you.

    He's just hoping you won't call his bluff with the threats. He obviously misled you. Def call ebay and open a claim.

    the seller is not going to take anyone to court, he is bluffing. any ebay seller certainly would not want their selling practices to be put under a microscope. tell the seller to go to hell.

    It's a scare tactic. He purposely sent that to you because he's attempting to intimidate you into changing your feedback from a neg to a pos.

    Don't fall for it. He has no case. You have the right as a buyer, and seller, to leave any feedback you wish so long as you are not intentionally leaving a neg without merit.

    He has no case, and he is not going to file one. I can' t see him spending the travel expense, room accommodations, and meals, plus filing fees, over a neg.

    Even if by some slim chance he wins his case, he' only getting his filing fees added to any judgement, not his travel, hotel, and meals. He's still out.

    The only way I know of that your negative feedback will be removed is if you sent him an eBay message threatening a negative. That's fb extortion, & even if deserved, it will be removed. I sold a coin once and the buyer sent me a msg saying he would keep it but he wanted a partial refund of $60 or he would give me a negative. I called eBay and they said his fb would be removed if he did. I messaged him back and told him I take returns for a full refund. No partial refunds. He sent it back and we had no problem.

    If you are going to leave negative feedback, then you should be prepared to back it up and stand up for your comments.

    I never threatened him in any messages that I sent him....

    I sent him two messages after I received the coin and they are as followed....

    "I got my coin today, still trying to figure out if it's the same coin as pictured. In the listing the coin looks almost red, the coin I got in the mail is more of a brown color that shows wear on the cheek and ear, while the listing shows a mint state coin. Just wondering what you did to the picture to get it to appear that color and is the coin you sent me the same coin? "

    2nd message, which included the pictures I posted here(above), as well as the coin in the listing, cropped...

    "The first picture is the one you listed on eBay, the last three are the coin in hand and what the coin actually looks like.

    The color isn't even close to the same. Not to mention all the wear on the cheek and ear are not shown as they should be on your coin. There are 3 cuts on the front of the coin across Lincolns jacket which you can clearly see in my pictures which do not show up in your pictures. I would not have bid or paid $200 for the coin in my pictures as shown as the wear and marks are obvious. I would not have paid more than $150 for this coin as I pictured it. This has to be the most doctored coin I've ever bought on ebay! Your listing says no returns as the coin in the pictures is the actual coin I was bidding on, but I beg to differ"

    We are currently going through the dispute on eBay where he clearly states he will not refund me for the coin and that the pictures I took aren't accurate because I haven't taken the coin out of the holder... I guess if I take the coin out it will magically appear red?

    Here are the pictures I uploaded to the dispute along with his pictures in the listing.

    The bottom line is that returns are requisite on ebay whether uncertified, certified, or certified and CAC approved. Customers have a right to return for any reason. Personally it looks like you may be making a mountain out of a mole hill; just work through ebay. This guy would have saved himself a lot of trouble getting the coin certified. And ebay will remove negative feedbacks especially for very active sellers that are power sellers.

    It appears to me the seller's images are much much lower resolution then your images.
    OF course, the defects aren't as clear in the low resolution images.

    Item not as described.

    Send it back with signature required.

    He's obligated to take the return and you'll get your money back under eBay buyer protection since the item you received does not look like the coin pictured in the auction.

    End of story. And, don't remove your negative feedback. This guy should get slammed for selling garbage like this with doctored photos. It's almost 2014, if you can't take an in focus picture of larger than 150 pixels square then you shouldn't be selling online. :mad:

    Did I miss something in this thread.......???????????? The coin pictured in the listing shows a ungraded coin and the coin recieved from the seller looks to be in a PCGS holder..... this alone would be reason to send the coin back............it was misrepresented in the listing...what is the grade stated on the slab ??? and can you post a picture of the whole slab ?? the coin in the slab you just posted a few replies back looks really nice ...maybe a AU -53 to a AU55...maybe higher.

    Yes, you missed something.;) The coin is in a snap-close plastic holder like Whitman sells, or used to sell, for about 25-cents each.

    I like the coin more in your pictures than those in the ebay listing even though that scratched acrylic holder is in the way, maybe you can take it out of that holder and take another picture.

    Later edit: I just realized you can't take it out since you want to return it, sorry.
