I don't understand why they would side with him when he has done this to other people besides you....you would think that after the first time doing this ebay would never let you claim that again, especially not so soon....sorry man
Yeah he has done it at least 3 times in the past 2 months. That should be kinda obvious, which is why I am surprised this was not fought harder.
The one time I had something similar happen on one of my sales they asked me for the tracking and delivery confirmation, i gave it and said ok you are fine.
It's for this very reason I stopped selling my duplicates on eBay. If the credit card companies, PayPal and eBay don't do something about these bottom feeders I really do believe that e-commerce will become a thing of the past. Their current stance makes it possible for dishonest buyers to repeat their scams with impunity, payment is optional.
I'm really not trying to be a smart alec, but do you check the feedback before mailing items? Being unable to leave negative feedback makes it almost impossible to find previous scams especially on an active account with pages of meaningless feedback.
It's so clear what has happened here that eBays response defies common sense but sadly this is no longer unusual. I hope Karma pays this scumbag a visit soon.
Ebay has become a buyers market rather than a sellers market. Though it is still larger than other sites, the fees and lack of seller protection is making it hazardous to sell on. What I don't understand is how can they side with the buyer when the item is marked delivered. What more proof do they want?

I spoke with paypal yesterday. I was informed because of the nature of the chargeback... (code 063 defective merchandise) that Paypal could not sucuessfully dispute the chargeback.... tho they tried the lady said.
I am about to get on the phone with EBay customer support and let them know about this guy at least.

Ask them if they would go into further detail as to what their definition of defective merchandise is. Then as Rodeo stated ask them how it is considered defective when the buyer stated that he never received it. If that hasnt sparked a light bulb in the person's brain, I don't know what else will. Maybe you want to speak with their supersvisor.

Surely if it can be shown that this scam is a pattern with this clown, then something can be done. Question is, will ebay or paypal even listen, or take a few minutes to look into the matter.

I'm pretty sure that this violates the letter of eBay's Seller Protection policy, as well as its spirit. I don't know what sort of appeal process is available these days, but I wouldn't be willing to let go of this. If the buyer can just say "I never got it, and besides, it was defective", and get off scot-free, there is no Seller Protection at all.
I know people who have worked for call centers' and it is not as easy as you put it. It is high pressure they have to quickly (not accurately) resolve issues , they have to sit on call for hours straight with only few 5 mins breaks between and they get barely over minimum wage.
